The Locus is a vacant lot located within a major commercial development subdivision off Arrowhead Drive created by Kenneth C. Coffin, Inc. (hereinafter the "Coffin Subdivision "). There are various commercial and industrial businesses operated by several independent owners within the Coffin Subdivision. The Coffin Subdivision is located in an area that has been re- zoned Commercial Industrial — CI Zoning District, although the Coffin Subdivision lots are currently subject to the RC -2 Zoning District classification "zoning freeze" that expires on October 15, 2017.* [ *The Zoning Use Chart under §139 -7A, as amended, provides that interior and/or exterior storage or warehousing is a permitted use in the CI Zoning District but requires a Special Permit for such use in the RC -2 Zoning District.] PREVIOUSLY GRANTED RELIEF UNDER SPECIAL PERMIT 4035 -13 Applicant previously submitted and obtained relief by Special Permit #035 -13 under §139 -30 and §139 -7A, wherein the Board unanimously approved interior and/or exterior storage or warehousing of portable toilets, equipment, tools and supplies, subject to certain conditions set forth in the Board Decision VOTED July 11, 2013, and dated September 23, 2013, registered at the Registry District of Nantucket County as Document No. 142978. MODIFICATION OF SPECIAL PERMIT RELIEF #035 -13 Applicant seeks Board approval for modification of previously granted relief by Special Permit #035 -13, under §139-30 and §139-7A, as follows: 1. Permit interior storage or warehousing of portable toilets, equipment, tools and supplies within the proposed one (1) story 42' X 48' commercial building approximately 2,016± sq. ft. sited as shown on the Proposed Site Plan of Land in Nantucket, Mass. prepared by Island Surveyors, LLC, dated February 11, 2014. (A copy of the Proposed Site Plan is included herewith.) 2. Designation and siting of a 14' X 35' loading zone, two (2) 9' X 20' parking spaces, driveway and apron accessing the Locus and twenty (20 %) percent open space area free from impervious surfaces, as shown on the Proposed Site Plan, in accordance with applicable provisions under §139- 16E(1), 139 -18, 139 -19, 139 -20 and 139 -20.1. 3. The Board recognized that the intention of the developer of the Coffin Subdivision was to sell lots within the subdivision for commercial told industrial uses and, in fact, other lots in the Coffin Subdivision had been previously conveyed to persons and businesses fur commercial mid industrial uses. In fact, use restrictions within the Subdivision approval issued by the Planning Board prohibit residential use unless it is for employee housing ancillary to the commercial use of a site. 7. 'fhc Board found that applicant's proposed use of the locus was in harmony with the general purpose and intent for commercial and industrial uses of lots within the Coffin Subdivision. The Collin Subdivision is located in an area that has been re- zoned Commercial Industrial — Cl Zoning District. although the Coffin Subdivision lots are currently subject to the RC -2 zoning classification "zoning freeze" that expires on October 15, 2017. The Board determined that granting a special pewit for interior and/or exterior storage or warehousing of portable toilets, equipment, fools and supplies should be approved subject to certain conditions as follows: (a) The hedge, as shown on the Site Plan attached hereto, shall be extended to encompass and screen die locus on all sides of the locus, excluding only the driveway access over the apron shown thereon. The applicant, if they choose to do so, may extend the hedge around the perimeter of Lot 205 without screening between the two lots, so long as they are in common ownership and Lot 205 is vacant. tb) The hedge surrounding the locus, excluding the driveway access over the apron shown on the Site Plan, shall be planted within one(]) year from the mate of this Decision and shall be. at n minimum, four (4) feet in height. (c) The 14 X 35 loading zone, two (2) 9 X 20 parking spaces, driveway and apron accessing the locus, and 200.-0 open area we designated on the Site Plan and shall be maintained in accordance with applicable provisions under §139 -18, 139 -19. 139-20 mid 139.20.1; further, the building to be constructed thereon, in size no greater than 20 X 40, shall be sites/ within the designated building envelope shown on the Site Plan. (d) Although relief under a special permit requires substantial satisfaction within two (2) years of issuance of the decision granting the special permit, this Decision approves a phased implementation of this permit. Construction of a building within the building envelope shown on the Site Plan, without further relief from this Board, shall be permitted provided a building permit application is submitted prior to the RC -2 "zoning freeze" expiration date of October 15, 2017. The Board determined that the applicant's proposed modification of the previously granted Special Permit #035 -13 was an improvement in that the exterior storage area was eliminated and the larger 42 X 48 building would provide interior storage of applicant's portable toilets, equipment, tools and supplies. Further, the substitution of a proposed six (6') foot chain link fence in place of the four (4') foot hedge was acceptable in that exterior storage of portable toilets, equipment, tools and supplies was eliminated and chain link fences have been installed on other lots within the Coffin Subdivision. 9. The Board found that applicant's proposed use of the locus was in harmony with the general purpose and intent for commercial and industrial uses of lots within the Coffin Subdivision and approved that modification of previously granted Special Permit #035 -13 subject to certain conditions as follows: (a) Permit interior storage or warehousing of portable toilets, equipment, tools and supplies within the proposed 42 X 48 commercial building approximately 2,016± sq. ft. to be constructed and sited as shown on the Proposed Site Plan of Land in Nantucket, Mass. prepared by Island Surveyors, LLC, dated February 11, 2014. (A copy of the Proposed Site Plan is attached herewith and made a part hereof.) (b) Designate and site a 14 X 35 loading zone, two (2) 9 X 20 parking spaces, driveway and apron accessing the Locus and twenty (20 %) percent open space area free from impervious surfaces, as shown on the Proposed Site Plan. (c) Install a chain -link fence a minimum of six (6) feet in height on the perimeter boundary lines along three (3) sides of the Locus as shown on the Proposed Site Plan. (d) Construction of the 42 X 48 commercial building and installation of the chain -link fence, as shown on the Proposed Site Plan, will be performed within eighteen (18) months of the date of this Board Decision. 10. Accordingly, by UNANIMOUS vote, this Board grants relief to the applicant by Special Permit under §139-30 and §139-7A, and approves the modification of previously granted Special Permit #035 -13 to allow for interior storage or warehousing on the locus and construction, installation and siting of improvements to the locus as shown on the Site Plan a reduced copy of which is attached hereto as Exhibit A, in accordance with the conditions set forth herein.
