Any action appealing the Decision must be brought by filing a notice of
appeal, specifying the grounds thereof, with the Town Clerk, pursuant
to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the Application submitted by the Applicant, the Zoning
Administrator determined pursuant to Nantucket Zoning By -Law § 139 -
33.A(3)(a) that the proposed alteration and structural change to the pre - existing,
non - conforming structure does not increase its nonconforming nature.
2. The Applicant proposes to alter the existing locus by installing and extending a
rear deck, as permitted in Nantucket Historic District Commission Certificate of
Appropriateness No. 61189. The Locus further benefits from an Order of
Conditions (MassDEP SE48 -2566) issued by the Nantucket Conservation
Commission approving work within the buffer zone bordering on a vegetated
wetland. The proposed rear wooden deck will replace and extend an existing
concrete and stone patio and will be sited outside the setbacks.
3. The existing locus, shown on the plan entitled "Mortgage Inspection Plan in
Nantucket, Mass. ", prepared by Blackwell & Associates, Inc., dated June 30,
1992, a reduced copy of which is attached herewith as "Exhibit A", is pre-existing
nonconforming as to side yard setbacks, being sited as close as approximately 1.1
feet from the westerly side yard lot line in the R -1 zoning district which requires a
minimum five (5) foot side yard setback. The proposed alterations, as shown on
the plan entitled "Plan to Accompany An Amended Order of Conditions Request
SE48 -2566 #60 Cliff Road in Nantucket, Massachusetts ", prepared by Nantucket
Surveyors, Inc., dated January 17, 2014 and revised on February 5, 2014, a
reduced copy of which is attached herewith as "Exhibit B ", will not increase the
side yard setback intrusions and will be located entirely within the buildable area
of the lot.
4. Therefore, because the proposed alterations will not result in an increase to the
pre- existing non - conforming side yard setbacks, the Zoning Administrator finds
that the proposed work will not increase the pre - existing nonconforming nature
of the structure or the Locus.
