1. Upon review of the Application submitted by the Applicant, the Zoning
Administrator determined pursuant to Nantucket Zoning By -Law § 139 -
33.A(3)(a) that the proposed alteration and structural change to the pre- existing,
non - conforming structure does not increase its nonconforming nature.
2. The Applicant proposes to alter the existing structure by expanding an existing
ground floor deck along a portion of the northerly elevation of the dwelling, as
permitted in Nantucket Historic District Commission Certificate of
Appropriateness No. 60130. The proposed 5' x 11' rear porch will replace an
existing 3' x 3' stoop and will be sited outside the setbacks.
3. The existing locus, shown on plan entitled "Mortgage Inspection Plan in
Nantucket, Massachusetts ", prepared by Nantucket Surveyors, Inc., dated
December 30, 1992, a reduced copy of which is attached herewith as "Exhibit A",
is pre - existing non - conforming as to lot size having a lot size of 2,729 square feet
in the ROH zoning district which requires a minimum lot area of 5,000 square
feet; and as to frontage, having 30.48 feet of frontage on Main St. in a zoning
district requiring a minimum frontage of fifty (50) feet. The structure is pre-
existing nonconforming as to side yard setbacks, being sited as close as
approximately 1.1 feet from the easterly side yard lot line and 2.2 feet from the
westerly side yard lot line in a zoning district which requires a minimum five (5)
foot side yard setback; and as to ground cover ratio, having a ground cover ratio
of 50.2% when a maximum of 50% is allowed. The proposed alterations will not
increase the side yard setback intrusions or ground cover ratio and will be located
entirely within the buildable area of the lot.
4. Therefore, because the proposed alterations will not result in an increase to the
pre - existing non - conforming side yard setbacks or ground cover, the Zoning
Administrator finds that the proposed work will not increase the pre- existing
nonconforming nature of the structure or the Locus.
