DECISION:
1. Upon review of the Application submitted by the Applicant, the Zoning
Administrator determined pursuant to Nantucket Zoning By -Law § 139- 33.A(3)(a)
that the proposed alteration, extension, and structural change to the pre- existing non-
conforming structure does not increase its non - conforming nature.
2. The Applicant proposes to alter the pre- existing nonconforming structure by building
an addition to the 400 square foot dwelling sited outside the setbacks as permitted in
Nantucket Historic District Commission Certificate of Appropriateness No. 61216.
The alterations consist of an extension on the east side of the structure with a total
additional ground cover of 200 square feet, bringing the dwelling's entire ground
cover to 600 square feet. The proposed addition will increase the ground cover of the
entire lot from approximately 21% to approximately 25% in a zoning district where a
maximum 30% ground cover is allowed.
3. The structure, Unit 2 of the Forty-Seven Pleasant Street Condominium, is pre-
existing nonconforming as to side and rear yard setbacks being sited as close as 4.40
feet from the southerly side yard lot line and 2.00 feet from the westerly rear yard lot
line in the R -1 zoning district where a minimum five (5) foot side and rear yard
setback is required. The locus, shown on the plan entitled "Plot Plan of Land in
Nantucket, Ma. ", prepared by john J. Shugrue, Inc., dated May 19, 2006, a reduced
copy of which is attached herewith as "Exhibit A ", is pre-existing nonconforming
with respect to lot size, having an area of approximately 4,840 square feet in a zoning
district with a minimum lot size requirement of 5,000 square feet. The two structures
on the lot, Units 1 & 2, pre -exist the adoption of the zoning by -law. The proposed
alterations will not increase the side or rear yard setback intrusion and will be located
entirely within the buildable area of the lot.
4. Therefore, because the proposed alterations, as shown on the Site Plan entitled,
"Leslie Oliver Residence; 47A Pleasant Street; Unit 2, Nantucket, Ma.; Addition ",
prepared by Sandcastle Construction, Inc, dated February 17, 2014, a reduced copy
of which is attached herewith as "Exhibit B ", will not result in an increase to the pre-
existing non - conforming side and rear yard setbacks, the Zoning Administrator finds
that the proposed work will not increase the pre - existing nonconforming nature of
the Locus.
