Upon review of the Application submitted by the Applicant, the Zoning Administrator determined pursuant to Nantucket Zoning By-Law § 139- 33.A(3)(a) that the proposed alteration and structural change to the pre-existing, non-conforming structure does not increase its nonconforming nature. 2. The Applicant proposes to alter the existing structure by expanding an existing ground floor deck along a portion of the southerly elevation of the dwelling, as permitted in Historic District Commission Certificate of Appropriateness No. 61070. Applicant also proposes to build a sixty-eight (68) square foot shed sited outside the setbacks, as permitted in Historic District Commission Certificate of Appropriateness No. 61179. This shed does not require relief. 3. The locus is pre-existing non-conforming as to lot size having a lot size of 7,301 square feet in the R-10 a zoning district which requires a minimum lot area of 10,000 square feet. The structure is pre-existing nonconforming as to front yard setback, as shown on the plan entitled `Building Location Plan of Land in Nantucket, Mass.", prepared by Hart-Blackwell & Associates, Inc., dated February 18, 1992, a reduced copy of which is attached herewith as "Exhibit A". The structure is sited as close as approximately 12.9 feet from the southerly front yard lot line in a zoning district which requires a minimum twenty (20) foot front yard setback. The proposed alterations will not increase the front yard setback intrusion and will be located entirely within the buildable area of the lot. 4. Therefore, because the proposed alterations, as shown on the modified site plan entitled, "Building Location Plan of Land in Nantucket, Mass.",prepared by Hart- Blackwell & Associates, Inc., dated February 18, 1992, a reduced copy of which is attached herewith as "Exhibit B", will not result in an increase to the pre- existing non-conforming front yard setback, the Zoning Administrator finds that the proposed work will not increase the pre-existing nonconforming nature of the structure or the Locus.
