1. Upon review of the Application submitted by the Applicant, the Zoning
Administrator determined pursuant to Nantucket Zoning By -Law § 139 -
33.A(3)(a) that the proposed alteration and structural change to the pre- existing
non - conforming structure does not increase its non - conforming nature.
2. The Applicant proposes to alter the existing structure by building an addition to
the portion of the dwelling sited outside the setbacks as permitted in Historic
District Commission Certificate of Appropriateness No. 60939. No change in use
of the structure on the locus is proposed. The alterations consist of an extension
on the north side of the structure with a total additional ground cover of 224
square feet, bringing the dwelling's entire ground cover to 1,020 square feet. The
proposed addition will increase the ground cover of the entire lot from
approximately 12.2% to approximately 14.4% in a zoning district where a
maximum 25% ground cover is allowed.
3. The structure is pre- existing nonconforming as to front yard setback, as shown on
the plan entitled `Building Location Plan of Land in Nantucket, Mass. ", prepared
by Chip W. Hart & Associates, Inc., dated April 22, 1993, a reduced copy of
which is attached herewith as "Exhibit A ". The structure is sited as close as
approximately 6.5 feet from the westerly front yard lot line in a zoning district
which requires a minimum twenty (20) foot front yard setback. The proposed
alterations will not increase the front yard setback intrusion and will be located
entirely within the buildable area of the lot.
4. Therefore, because the proposed alterations, as shown on the modified site plan
entitled, `Building Location Plan of land in Nantucket, Mass. ", prepared by Chip
W. Hart & Associates, Inc., dated April 22, 1993, a reduced copy of which is
attached herewith as "Exhibit B ", will not result in an increase to the pre- existing
non - conforming front yard setback, the Zoning Administrator finds that the
proposed work will not increase the pre- existing nonconforming nature of the
Locus.
