Upon review of the Application submitted by the Applicant, the Zoning Administrator determined pursuant to Nantucket Zoning By -Law § 139- 33.A(3)(a) that the proposed alteration, reconstruction, and structural change to the existing, nonconforming structure does not increase its nonconforming nature. 2. The locus is located at 15 E. Tristram Ave, is shown on Nantucket Tax Assessor's Map 31 as Parcel 36, is shown as Lot 10 on Land Court Plan 12708 -H, filed with Nantucket Registry District, and is located in the Limited Use General 2 (L.U.G. 2) zoning district. 3. The Applicant proposes to demolish the southern portion (about 1,076 SF + / -) of the pre - existing, nonconforming structure on the locus and reconstruct a replacement in substantially the same location, with minor variation as to volume, shape and location of the alteration, but with no additional ground cover and no new nonconformities or increases to the existing nonconformities. No portion of the structure to be demolished and reconstructed is in the side yard setback and no additional ground cover is proposed. The lot and structure will remain nonconforming (27,500 SF of lot size in a zone that requires 80,000 SF, a ground cover ratio of 9.1 % +/- in a zone that allows 4 %, and a portion of the structure as close as 13.9' +/- to the side yard lot line where the setback is 15'. The locus and structures thereon are conforming in all other dimensional respects. No change in use of any structures on the locus is proposed. 4. Because this lot was created pursuant to MGL c. 41, § 81P, based upon the exception in the clause of MGL c. 41, § 81L, and the above nonconformities existed at that time, they are treated as pre - existing nonconformities under the Nantucket Zoning By -law, as per section 139- 33.A.8. 5. Based on the site plans showing existing and proposed conditions on the locus, dated February 26, 2014, prepared by Blackwell & Associates, Inc., reduced copies of which are attached hereto and marked as "Exhibit A ", the Zoning Administrator finds that the proposed work will not create a new nonconformity or increase the nonconforming nature of the Locus. The proposed alteration of the structure, or a substantially similar alteration, as proposed, will not result in an increase to any setback nonconformity, any increase in the ground cover ratio, or any decrease in lot size. No other use or dimensional change is proposed. The Zoning Administrator notes that changes to the shape of the reconstructed portion of the dwelling as required by the Historic District Commission will not require additional review provided that no new nonconformities are created and no existing nonconformities me increased.
