DECISION:
1. Upon review of the Application submitted by the Applicant, the Zoning
Administrator determined pursuant to Nantucket Zoning By -Law § 139 -
33.A(3)(a) that the proposed alteration, reconstruction, and structural change to
the existing, nonconforming structure does not increase its nonconforming nature.
2. The Applicant proposes to pick up the pre - existing, nonconforming structure on
the locus, construct a basement, and place the structure back in the same location
as permitted in Historic District Commission Certificate of Appropriateness No.
60636. No change in use of the structure on the locus is proposed.
The Locus is pre - existing nonconforming as to lot size, ground cover ratio, and
side and rear yard setback, as shown on the plan entitled "Mortgage Plot Plan in
Nantucket, MA, 54 Fair Street (Nantucket County) ", prepared by Joseph E.
Marcklinger PLS dated August 1, 2007. The lot contains approximately 2,370
square feet in a zoning district requiring a minimum lot size of 5,000 square feet.
The structure is sited as close as approximately 1.2 feet from the northerly side
yard lot line in a zoning district which requires a minimum 5 foot side yard
setback. The existing ground cover ratio is 47.7% in a zoning district which
requires a maximum allowable ground cover of 30% for undersized lots. The
structure is sited as close as 0.2 feet from the easterly rear yard lot line in a zoning
district which requires a minimum 5 foot rear yard setback. The proposed
alterations will not be closer to the side and rear yard setbacks and will not
increase the ground cover ratio of the existing structure.
4. Therefore, because the proposed alterations will not result in an increase to the
pre - existing non - conforming ground cover and will not be closer to the side and
rear yard setbacks, the Zoning Administrator finds that the proposed work will not
increase the pre- existing nonconforming stature of the Locus.
