DECISION:
1. Upon review of the Application submitted by the Applicant, the Zoning
Administrator determined pursuant to Nantucket Zoning By -Law § 139 -
33.A(3)(a) that the proposed alteration, reconstruction, and structural change to
the existing, nonconforming structure does not increase its nonconforming nature.
2. The Applicant proposes to renovate the structure by adding a second story to the
portion of the structure sited outside the setbacks as permitted in Historic District
Commission Certificate of Appropriateness No. 60959. No change in use of the
structure on the locus is proposed.
3. The Locus is pre- existing nonconforming as to side and rem yard setback, as
shown on the plan entitled "Mortgage Plot Plan in Nantucket, MA, 48 Orange
Street ", prepared by Joseph Marcklinger PLS dated August 25, 2013. The
structure is sited as close as approximately 1.9 feet from the northerly side yard
lot line, 2.9 feet from the southerly side yard lot line, and 3.2 feet from the
easterly rear yard lot line in a zoning district which requires a minimum 5 foot
side and rear yard setback. The proposed alterations will not be closer to the side
and rear yard setbacks and will be located entirely within the buildable area of the
lot.
4. Therefore, because the proposed alterations will not result in an increase to the
pre- existing non - conforming side and rem yard setbacks, the Zoning
Administrator finds that the proposed work will not increase the pre - existing
nonconforming nature of the Locus.
