The present location of the dwelling was approved by the issuance of a variance (file 016 -08) in June of 2008. At that time the property was also re-zoned to R -2 which is presently called SR -20. The new construction is outside of the non conformity area and no needs no further relief from setback. There is no ground cover issue with the added square footage and there is no relief necessary for that I have included old ZBA decisions and HDC approvals with this application for your files and to help facilitate the present requested relief. NANTUCKET BOARD OF APPEALS 2 FAIRGROUNDS ROAD NANTUCKET, MASSACHUSETTS 02554 Assessor's Map 49 Parcel 114 Lot 4 & Lot A 80 Sankaty Road Plan Book 5, Page 14 Sconset Residential 20 (SR -20) Book 1115 Page 82 DECISION: At a public hearing of the Nantucket Zoning Board of Appeals (Board) on Thursday, March 13, 2014, at 12:00 p.m., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of KEVIN C. WERLE and WENDY E. WERLE, of 11 Old Stone Crossing, West Simsbury, Connecticut, 06092, File No. 13 -14: 1. The Applicant is requesting Variance relief pursuant to Zoning Bylaw 139 -32 to alter the existing structure by adding shed dormers and windows to this two story dwelling. The dwelling is non - conforming with respect to side yard setbacks and benefits from a previously issued Variance (ZBA Application File No. 016 -08). The proposed alterations will not increase the non - conforming setbacks. The Locus is situated at 80 Sankaty Road, is shown on Assessor's Map 49 Parcel 114, as Lots 4 and A in Plan Book 5 Page 14, and evidence of owner's title is recorded at Book 1115, Page 82 on file at the Nantucket County Registry of Deeds. The site is zoned Sconset Residential 20 (SR -20). 2. Our decision is based upon the application and accompanying materials, representations, and testimony received at our public hearing. There was no Planning Board recommendation on the basis that no matters of planning concern were presented. There were no letters in favor of, or in opposition to, the application. 3. Val Oliver and Timothy McClure represented the Applicant and stated that this non - conforming structure is a single family dwelling, built in 1978, with an attached deck and steps, outdoor shower and refuse bin, and is shown on plan entitled, "Mortgage Inspection Plan in Nantucket, Ma. ", dated November 26, 2007, prepared by Blackwell & Associates, Inc., attached hereto as "Exhibit A ". The dwelling is non - conforming with respect to side yard setbacks, being sited as close as three (3) feet from the northerly side yard lot line, in a zoning district where a ten (10) foot side yard setback is required. The locus benefits from Variance relief granted in Board of Appeals Decision No. 016 -08 and recorded with the Nantucket Registry of Deeds at Book 1146 Page 272. Said Variance relief, pursuant to Nantucket Zoning Bylaw Sections 139 -32 and 139 -16, was granted in order to: (1) treat the zoning classification of the locus as R -2 (now known as SR -20) instead of LUG -3, and; (2) to reduce the side yard setback to three (3) feet to validate the location of the existing structure. The Historic District Commission has granted the Applicant Certificate of Appropriateness No. 60690 for the proposed work. Therefore, the BOARD makes a specific finding that a literal enforcement of the provisions of Nantucket Zoning By -law 139 -32 would involve substantial hardship and that the requested modification of prior Variance relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent and purpose of said by- law. The proposed alterations will not result in any additional side yard setback nonconfornities to the existing dwelling, are within the buildable portion of the Property, will not increase the ground cover or the height (30 feet) of the structure, and me architecturally appropriate as determined by the Nantucket Historic District Commission. 4. Accordingly, by UNANIMOUS VOTE of the sitting BOARD, the ZONING BOARD OF APPEALS grants a modification of prior Variance relief pursuant to Nantucket Zoning By -Law Section 139 -32 allowing the construction of shed dormers and windows to this two story dwelling with following conditions: a. The existing structure and proposed improvements shall be completed is substantial compliance with plan entitled "Wendy & Kevin Werle - Minor Revisions to COA #60416 ", dated November 18, 2013, prepared by Val Oliver Design., a reduced copy of which is attached hereto as `Exhibit B b. The proposed addition of shed dormers and windows will not increase the height (30 feet) of the structure. There was no Planning Board recommendation, on the basis that no matters of planning concern were presented. There was no opposition or support from the public presented at the public hearing. 4. As presented by counsel at the public hearing, the applicant requests to have the intensity benefits of the R -2 zoning district. The applicant noted that in order to re -zone his property, the appropriate avenue would be through a Town Bk: 01146 Pg: 274 Meeting. in order to expedite the process and receive substantially the same results, the applicant is instead requesting zoning relief. The applicant presented various documents (building permits, ZBA decisions, maps) that indicate the locus was incorrectly classified as R -2. The applicant submitted a GIB image showing the two zoning districts in the applicant's neighborhood. The first image showed the applicant's parcel relative to the R -2 zoned parcels to the south and east of his lot and the LUG -3 zoned parcels above his lot. The applicant, and those parcels abutting the applicant to the north, are zoned LUG-3 and are owned by Sankaty Head Golf Club. The applicant is one of the few residential properties in Siaeconset not to be zoned as R -2.
