DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals (Board) on
Thursday, March 13, 2014, at 12:00 p.m. (noon), at 4 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following decision on the application of KENNETH C.
COFFIN, INC. as Owner, and CHRISTOPHER J. LOFTUS, as Applicant, 2 Greglen Avenue,
P.M.B. 190, Nantucket, Massachusetts 02554, File No. 014 -14.
2. The applicant is requesting relief by Special Permit pursuant to Nantucket Zoning
By -Law §139 -30 and §139 -7A, in order to construct a contractor shop with light manufacturing
and interior and/or exterior storage or warehousing on the locus, and to the extent necessary a
waiver under §139 -20 of the By -Law for off -street loading zone, and Minor Site Plan review
pursuant to §139 -23 of the Zoning By -law. The Locus, a vacant lot located within the Coffin
Subdivision off Arrowhead Drive, is situated at 4 Flint Road, is shown on Nantucket Tax
Assessor's Map 69 as Parcel 337, and as Lot 202 on Land Court Plan No. 26984 -8. Evidence of
owners title is recorded on Certificate of Title No. 11346 on file with the Nantucket County
Registry District of the Land Court. Locus lies within an area currently zoned Commercial
Industrial (CI); however, the locus and the lots created by the Coffin Subdivision are subject to a
"zoning freeze" under the RC -2 Zoning District which expires on October 15, 2017.*
[ *The Zoning Use Chart under §139-7A, as amended, provides that interior or exterior storage or
warehousing is a permitted use in the CI Zoning District but requires a special permit for such
use in the RC -2 Zoning District.]
3. Our decision is based upon the application and accompanying materials, and
representations and testimony received at our public hearing. There was no Planning Board
recommendation on the basis that no matters of planning concern were presented. There was no
opposition, written or oral, to the application.
4. As presented to the Board by the applicant, applicant proposes to construct a
1,740 square foot contractor shop on the premises, with light manufacturing. The second floor
will be used as an office and dwelling unit for employees. The applicant submitted a proposed
site plan prepared by Ackme Survey LLC, dated January 31, 2014 (since revised), showing the
proposed building, required parking spaces, open space, and an off -street loading zone. All
dimensional requirements and the 20% open space requirement will be met.
5. The Board found that Applicant's proposed use of the locus is in harmony with
the general purpose and intent of the By -Law for commercial uses of lots within this zoning
district. The Board determined that granting a special pemrit for construction of a contractor
shop, with fight manufacturing, and an office and dwelling unit on the second floor, shall be
approved.
6. Accordingly, by UNANIMOUS vote, this Board grants relief to the applicant by
Special Permit, pursuant to Zoning By -Law Sections 139 -30 and Section 139 -7, to allow the
construction of a contractor shop with light manufacturing, interior storage and warehousing, and
an office and dwelling unit on the second floor, on the premises. This relief is subject to the
following conditions:
a. The proposed commercial building, puking, loading zone, and green space
shall be in substantial compliance with the revised plan entitled, "Nantucket
Zoning Board of Appeals Plot Plan, 4 Flint Road ", prepared by Ackme Survey
LLC, dated April 29, 2014, a reduced copy of which is attached hereto and
marked as "Exhibit A."
b. The premises shall maintain a minimum of 20% of open area free from
impervious surfaces as required by Section 139- 16E(1), in conjunction with the
use of the premises pursuant to this special permit.
c. The proposed improvements will include screening, either board fence or
vegetative, on both sides and to the rear of the property within six months of
occupancy.
d. There shall be no exterior storage.
