DECISION:
1. Upon review of the Application submitted by the Applicant, the Zoning
Administrator determined pursuant to Nantucket Zoning By-Law § 139-33.A(3)(a) that the
proposed alteration, reconstruction, and structural change to the existing, nonconforming
structure does not increase its nonconforming nature.
2. The locus is located at 7 & 11 Squam Road, is shown on Nantucket Tax
Assessor's Map 21 as Parcel 8, is shown as Parcel E on Land Court Plan 11019-E and Lot F1 on
Land Court Plan 11019-F filed with Nantucket Registry District, and is located in the Limited
Use General 1 (L.U.G. 1) zoning district.
3. The Applicant proposes to pick up one of the pre-existing, nonconforming
structures on the locus and put it back down on a new foundation and to construct a retaining
wall to support the existing, failing timber retaining wall. As so relocated the structure will be
less nonconforming as to side yard setback but will still be nonconforming, having a minimum
setback of about 6.3 feet from the cornerboard and about 3.4 feet from the crawlspace accessway
following construction. No change in use of any structures on the locus is proposed.
4. As found in the Zoning Board's decision in File No. 059-97, registered with
Nantucket Registry District as Document No. 78659, the locus is preexisting, nonconforming as
to use, containing a total of three dwelling units, and as to side yard setback, with the structure in
question currently having no side setback. Following the proposed reconstruction, the side yard
setback of the structure in question will be less non-conforming than current dimensional
conditions.
5. Based on the site plan showing existing and proposed conditions on the locus and
entitled, "Site Plan of Land for A Zoning Administrative Decision in Nantucket, Ma." (two
sheets), dated November 13, 2013, prepared by Blackwell & Associates, Inc., a reduced copy of
which is attached hereto and marked as "Exhibit A", the Zoning Administrator finds that the
proposed work will not increase the nonconforming nature of the Locus. The proposed relocation
and alteration of the structure will not result in an increase to any setback nonconformity and in
fact will cause the structure to be less nonconforming as to side yard setback. No change use or
in ground cover or other dimensional requirement is proposed.
