An Appeal from this Decision to the Zoning Hoard of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a notice of
appeal, specifying the grounds thereof, with the Town Clark, pursoant
to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the application submitted by the Applicants for the above - referenced
property, it was determined by the Zoning Administrator that pursuant to Nantucket
Zoning Bylaw Section 139- 33.A.(8), the proposed reconfiguration of the lot does not
increase the nonconforming nature of the locus.
2. The Applicants are proposing to convey a 37 square foot portion of their property
with their direct abutter, the owner of 58A Orange Street. The abutter will
simultaneously convey a 37 square foot portion of his property to Applicants. Upon
completion of this transaction, the properties of both parties will remain unchanged in
lot size and frontage, although they will have slightly different configurations.
3. The locus, shown as Lot l on the plan entitled, `Plan of Land in Nantucket, Mass.
Prepared for Town of Nantucket," dated August 5, 2013, prepared by Island
Surveyors, LLC, and attached hereto as "Exhibit A ", is pre- existing non - conforming
with respect to lot size, side yard setback, and frontage pursuant to Nantucket Zoning
By -law Section 139.16.A. The existing total lot area of Lot 1 is 3,041 square feet with
a frontage of 15.15 feet. The proposed reconfiguration of the lot through a swap of
equally sized parcels with the abutter will result in no changes to the foregoing.
4. Therefore, because the proposed re- division of Lot 1 into Lots 3 and 5 and the
proposed swap of Lot 3 (lot area of 37 square feet) for Lot 6 (lot area of 37 square
feet), all shown on the plan entitled, "Plan of Land in Nantucket, Mass., Prepared for
Michael Lynch," dated October 7, 2013, prepared by Island Surveyors, LLC, and
attached hereto as "Exhibit B ", neither increase an existing nonconformity nor create
any new non - conformities, the Zoning Administrator finds that the reconfiguration of
the locus will not be substantially more detrimental to the neighborhood.
