DECISION:
1. Upon review of the application submitted by the Applicant for the above-referenced
property, it was determined by the Zoning Administrator that pursuant to Nantucket
Zoning Bylaw Section 139-33.A.(3)(a), the proposed addition and alterations to the
structure does not increase the nonconforming nature of the locus.
2. The Applicant is proposing to alter the existing dwelling by building additions that
will not increase the pre-existing nonconforming nature of the structure. The
proposed work on the dwelling, a 709 square foot two story structure, involves:
raising the structure to build a full foundation with bulkhead that will exactly match
the existing footprint (the bulkhead will be sited under an existing porch on the north
side of the structure); a second floor addition; an extension on the southwest corner
with a 12 square foot addition within the footprint of the existing deck. The total
additional ground cover for this structure will be 12 square feet, bringing the entire
ground cover for the lot to 1,290 square feet. The proposed additions are within the
buildable portion of the Property.
3. The locus is pre-existing non-conforming with respect to lot size, ground cover ratio
for the Village Residential zoning district, setbacks and frontage pursuant to
Nantucket Zoning By-law Section 139.16.A. The total lot area is 10,936 square feet
with an existing total ground cover of 1,278 square feet and an existing ground cover
ratio of 11.7%. However, the lot has the advantage of utilizing Nantucket Zoning
By-law Section 139.E.2 (b) which allows up to 1,500 square feet of ground cover for
a lot containing at least 5,000 square feet. Applicant has been granted Historic
District Commission approval at Certificate of Appropriateness No. 60767.
4. Therefore, because the proposed additions and alterations will not result in any
additional non-conformities as shown on the site plan entitled, "Site Plan of Land in
Nantucket, Ma.," dated December 14, 2013, prepared by Blackwell & Associates,
Inc., and attached hereto as "Exhibit A", the Zoning Administrator finds that the
proposed work will not increase the nonconforming nature of the structure.

The cover page of the above referenced ZA Decision filed with the Town Clerk on December 19,2013,
requires updating of current Owner to enable the Applicant to record it with the Registry of Deeds. The
property was transferred from the prior owners
Suzanne Reid,Peter Schmid,and Nancy ,et Trustees of Schmid Realty Trust to the
current owner 9 E Street LLC in a deed executed on December 16,2013,and recorded with the Nantucket
Registry of Deeds at Document 143277. The ZA Decision was executed on December 18, 2013, and did
not reflect this transfer in ownership.The relief that was granted does not change and the appeal period
does not need need too restart.
