1. Upon review of the application submitted by the Applicant for the above - referenced
property, it was determined by the Zoning Administrator that pursuant to Nantucket
Zoning Bylaw Section 139- 33.A.(3)(a), the proposed addition to the structure does
not increase the nonconforming nature of the locus. _
The Applicant is proposing to alter the existing structure (dwelling) by building
additions on the north and west side of this 913 square foot cottage known as
"Capstan", Unit 4 of seven units in Crow's Nest Cottages Condominium. The total lot
area is 91,823 square feet with an existing total ground cover of 6,216 square feet
where 27,547 square feet of ground cover is allowed. The alterations consist of an
outdoor shower on the north side of the dwelling and extensions on southwest side of
the dwelling. The total additional ground cover for this unit will be 250 square feet,
bringing the dwelling's entire ground cover to 1,163 square feet. The proposed
additions are within the buildable portion of the Property and will increase the ground
cover of the entire lot from approximately 6.7% to approximately 6.9% in a zoning
district where 30% ground cover is allowed. Therefore, the additions will not create
any new non-conformities to either the structure or the lot.
3. The Locus is pre- existing non - conforming with respect to the siting of seven
structures on a lot where only two are allowed pursuant to 139- 7.B(1). Applicant has
been granted Historic District Commission approval at Certificate of Appropriateness
No. 60186 and an Order of Conditions for proposed work by the Conservation
Commission which has been recorded with the Nantucket Registry of Deeds as
Document 142648.
4. Therefore, because the proposed additions and alterations will not result in any
additional non-conformities as shown on the site plan entitled, "Site Plan To
Accompany A Notice of Intent in Nantucket, Ms.," dated September 26, 2013,
prepared by Michael Connolly & Associates, Inc., and attached hereto as "Exhibit
A ", the Zoning Administrator finds that the proposed work will not increase the
nonconforming nature of the on the Locus.
