Enclosed is the Decision of the Zoning Administrator which has this day
been filed with the office of the Nantucket Town Clerk.
An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a notice of
appeal, specifying the grounds thereof, with the Town Clerk, pursuant
to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the Application submitted by the Applicant, it was determined by
the Zoning Administrator that pursuant to Nantucket Zoning By -Law Section
139- 33.A.(3)(a), the proposed alterations to the structure do not increase the
nonconforming nature of said structure.
2. The Applicant is proposing to alter the pre -existing nonconforming structure
(dwelling) by placing a new foundation with a full basement under the existing
structure, without any changes in the footprint, massing or elevation above grade.
The Applicant is also proposing to eliminate an encroachment of the window
wells on the easterly side of the dwelling by reducing and siting the window wells
within the easterly side boundary lot line.
3. The structure (dwelling) on the locus is pre- existing nonconforming with respect
to the easterly side yard setback, being sited about 1.17± feet from the easterly lot
line, and rear yard setback, being sited about 1.1+ feet from the southerly lot line.
4. Based on the plan entitled "Proposed Site Plan" prepared for Kenneth L.
Beaugrand and Augusta B. Beaugrand — Locus 1 Farmer Street, prepared by
Bracken Engineering, Inc., dated November 15, 2013, attached hereto marked
Exhibit "A ", and the "Mortgage Plot Plan" prepared by Bracken Engineering,
Inc., dated October 24, 2013 — showing existing conditions of the locus and
dwelling sited thereon, attached hereto marked Exhibit "B ", the Zoning
Administrator finds that the proposed work will not increase the nonconforming
nature of the structure on the locus. Alterations to the dwelling structure will not
result in an increase to any setback nonconformities, and will result in no changes
in the footprint, massing or elevation above grade of the existing dwelling and
would eliminate the window wells encroachment on the adjoining lot.
