Upon review of the application submitted by the Applicant for the above - referenced property, it was determined by the Zoning Administrator that pursuant to Nantucket Zoning Bylaw Section 139- 33.A.(3)(a), the proposed addition to the structure does not increase the nonconforming nature of said structure. 2. The Applicant is proposing to alter the existing structure (dwelling) by building a second -story addition over the existing garage on the west side of the dwelling. The Applicant also proposes alterations to the north side of the dwelling which consist of the removal of two stoops/steps, currently sited as close as one (1) foot from the property line, and twenty -four (24) square foot addition which will be sited approximately 6.8 feet from the rear lot line. The proposed additions are within the buildable portion of the Property and will increase the ground cover from 29.7% to approximately 30% in a zoning district where 50% ground cover is allowed. Therefore, the additions will not create any new non - conformities. 3. The structure on the Locus is pre- existing non - conforming with respect to side and rear yard setbacks, being sited as close as one (1) foot from the rear yard lot line, with the rear stoop /steps being located approximately one (1) foot from the rear yard lot line, in a zoning district where a five (5) foot rear and side yard setback is required. 4. Therefore, because die proposed additions and alterations will not result in any additional side or rear yard setback nonconformities as shown on the site plan entitled, "Site Plan of Land To Accompany Request for Zoning Review in Nantucket, Ma.," dated November 25, 2013, prepared by Blackwell & Associates, Inc., and attached hereto as "Exhibit A ", the Zoning Administrator finds that the proposed work will not increase the nonconforming nature of the structure on the Locus and, in fact, decreases said non - conformities.
