It contains two dwellings of about 2,486+/- SF of ground cover or a ground cover ratio of about 21.7 %, where 30% is allowed, and about 81.89 feet of frontage where 50 fee[ is required. The main dwelling is as close as 5.9 feet from the eastern side lot line, where 5 feet of separation is required, except that 10 feet is required from any street or way, (see Zoning Bylaw Section 139- 16.C.3). The locus is otherwise dimensionally conforming. The building permits for the structures on the locus were applied for in 1995 and received Certificates of Occupancy in 1996 and 2008, with Building Location Plans by Charles W. Hart, P.L.S., done for each. Both plans show the western abutter as land of Norman and Priscilla Hillman, Lot 8 (way). Both Building Department applications are signed off by John H. Dunn, listing the side and rear yard setback as 5 feet. However, the rule requiring 10 foot setback on side yards adjacent to roads was adopted by Article 45 at the 1992 Town Meeting, and would have applied at the time, if the western abutter was considered a constructed or unconstrncted way. To the extent Section 139- 16.C.3 applies, the statute of limitations for enforcement ran long before the Applicant purchased the property in 2011. However, Applicant now seeks a Special Permit pursuant m Nantucket Zoning Bylaw Section 139- 16.C.2, which allows the Board of Appeals to validate unintentional setback intrusions not greater than five feet into a required yard and not closer than four feet from a lot line, provided that it shall first find that the burden of correcting the intrusion substantially outweighs any benefit to an abutter of eliminating the intrusion and, if the intruding structure was so sited after 1990, the siting of the structure was reasonably based upon a licensed survey, all of which apply here. The Applicant also seeks to construct an addition to the eastern side the main dwelling. The addition to the main dwelling is entirely outside the setback and does not increase nature of the existing nonconformity or create any new zoning nonconformity and is not substantially more detrimental to the neighborhood. To the extent necessary, Applicant also seeks relief from the Zoning Administrator or the Board of Appeals for such under Section 139 -33.A or otherwise. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, November 14, 2013, at 1:00 P.M., 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of Keith Block and Suzanne Kelley, c/o Reade, Gullicksen, Hanley, Gifford, and Cohen, LLP, 6 Youngs Way, Post Office Box 2669, Nantucket, Massachusetts 02554, File No. 076 -13: 2. Applicant requested Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139- 16.C.2, to validate unintentional setback intrusions and under Section 139 -33.A to construct an addition to the eastern side the main dwelling. 3. The locus is otherwise dimensionally conforming. However, the bylaw requiring 10 foot setback on side yards adjacent to roads was adopted by Article 45 at the 1992 Town Meeting, and would have applied at the time, if the western abutting property was considered a constructed or unconstructed way. 4. Our decision is based upon the application and accompanying materials, representations, and testimony received at our public hearing. There was no Planning Board recommendation on the basis that no matters of planning concern were presented. There were no letters or comments from the public. 5. Attorney Steven Cohen represented the Applicant at the hearing. Attorney Cohen explained to the Board the history of the property, the relief being sought, and the applicability of Section 139- 16.C.2 to validate unintentional setback intrusion. Attorney Cohen also noted that, to the extent Section 139- 16.C.3 applies, the statute of limitations for enforcement ran out long before the Applicant purchased the property in 2011, per M.G.L. 40A, Section 7. 5. Therefore, after a discussion with the agent for the Applicant, the Board finds that such a Special Permit for relief sought by the Applicant pursuant to Nantucket Zoning Bylaw Section 139 -16.C. would be for an intrusion not greater than five feet into the setback and not closer than four feet from a lot line, that correcting the intrusion substantially outweighs any benefit to an abutter, and that the intruding structure was sited after 1990 and was reasonably based upon a licensed survey. The Board also finds that the Special Permit relief pursuant to Section 139 -33.A for an addition to the eastern side of the main dwelling is not applicable because the structure does not have pre- existing nonconforming status. The proposed addition is located entirely outside the setback, therefore the Board finds that no further relief is required. 6. Accordingly, by a UNANIMOUS vote of the sitting Board, the Board of Appeals grants a Special Permit for the relief sought by the Applicant pursuant to Nantucket Zoning Bylaw Section 139 -16.C. to validate the existing setback intrusion as shown on the Plan attached hereto as Exhibit A.
