Upon review of the application submitted by the Applicant for the above - referenced property, it was determined by the Zoning Administrator that pursuant to Nantucket Zoning Bylaw Section 139- 33.A.(3)(a), the proposed alteration of the structure does not increase the nonconforming nature of said structure. 2. The Applicant is proposing to alter the existing structure, by removing the existing stairs and constructing an extension to the existing deck that will be at the same level as the existing deck. 3. The structure on the Locus is preexisting nonconforming with respect to side yard setback, with a 5.9' side yard setback where 10' is required, due to location of this lot at the intersection of two streets, North Liberty Street and Brock's Court. The structure is conforming to all other zoning requirements. 4. Therefore, because the alterations to the structure will not result in any additional side yard setback nonconformities, as shown on the site plan prepared by Blackwell & Associates, Inc. dated September 19, 2013, attached hereto as "Exhibit A ", the Zoning Administrator finds that the proposed work will not increase the nonconforming nature of the structure on the Locus.
