DECISION:
1. Upon review of the application submitted by the
Applicant for the above - referenced property, it was
determined by the Zoning Administrator that pursuant
to Nantucket Zoning Bylaw Section 139- 33.A.(3)(a), the
proposed addition to the structure does not increase
the nonconforming nature of said structure.
2. The Applicant is proposing to alter the existing
structure (dwelling) by constructing an approximately
102 square foot basement level addition to the rear of
the structure where a deck currently is sited. After
the addition is constructed, the deck will be
replaced. The proposed addition will be approximately
4 feet from the rear lot line, which is no closer than
the existing structure. The applicant also seeks to
expand a dormer on the west side of the structure.
The section of the structure where the proposed dormer
will be added is conforming to all zoning
requirements.
3. The structure on the Locus is preexisting
nonconforming with respect to rear yard setback, with
the rear of the structure being located about 3.5 feet
from the rear yard lot line, in a zoning district that
requires a 5 foot rear yard setback.
4. Therefore, because the proposed addition will be no
closer to the rear lot line than the existing
structure and because the section of the structure
where the dormer will be expanded is conforming to the
setback requirements as shown on the site plan
entitled, "Philbrick Residence, 4 Silver Street,
Nantucket, MA 02554," prepared by MWP Residential
Design dated September 16, 2013, attached hereto as
"Exhibit Al" and "Exhibit A2 ", the proposed work will
not increase the nonconforming nature of the structure
on the Locus.
