The Applicant seeks a Special Permit under Nantucket Zoning
By -law (the "By -law ") § §139 -30.A and 139 -33.A to alter and
extend a pre- existing, nonconforming structure. In the
alternative, the Applicant seeks relief by variance under
By -law §139 -32 from the provisions of By -law §139 -17.
The Applicant relocated a pre- existing, nonconforming
dwelling from the property at 85 Baxter Road in Siasconset
(Assessor's Map 49, Parcel 35) to the Locus. The dwelling
was constructed in the 1920's and was nonconforming as to
height. No changes were made to the dwelling when it was
relocated to Monomoy. As so relocated the dwelling meets
all dimensional requirements of the By -law except for
height, having a maximum height of about 32.6 feet, where
the maximum permissible height is 30 feet under By -law
§139 -17.
The Locus is located at 47 Monomoy Road, is shown on
Nantucket Tax Assessor's Map 54 as Parcel 295, is Lot 5 on
Land Court Plan No. 14029 -C at Nantucket Registry District,
and is located in the Limited Use General 1 ("LUG -1 ")
Zoning District.
