The locus property is located on Windy Way. The property was previously zoned Residential
Commercial, RC -2 and is now zoned Commercial Neighborhood, CN. The property was
previously located within the multi - family zoning district which was approved and enacted in
2009, and then repealed in 2013. Four dwelling units per lot were allowed in this zone as well as
first floor apartments. The owner /applicant would like to convert an existing office area to a first
floor apartment. No exterior work is proposed. A variance from Zoning Bylaw 139 -2(A):
Definition of Apartment is required to permit the apartment on the first floor. The proposal of the
third dwelling unit on the lot complies with the CN zoning requirement of 1 dwelling unit per
3,000 s.f. The existing lot area is 9,933 s.f.
The existing structure consists of four condominium units. Each is individually owned. The
individual units are designated by the following: Unit 1 — 3A Windy Way; Unit 2 — 3B Windy
Way; Unit 3 — 3C Windy Way; Unit 4 — 31) Windy Way. Unit 2 contains 295 s.f of office space
and 890 s.f. of warehouse space. Unit 3 consists of a one bedroom residential apartment. Unit 4
consists of a two bedroom residential apartment. The owners unit, unit 1, currently contains 484
s.f. of office space. The parking space requirements for CN zoning is 1 space/ bedroom as well
as the required space calculations for office and warehouse. See the attached parking calculation
sheet. The lot has 7 existing parking spots which is adequate for the proposed change of use.
The proposed first floor apartment conforms to the existing neighboring properties. These
properties contain commercial offices, retail and warehouse space, along with multiple dwelling
units located on first, second, and basement levels. An abutting condominium property located at
6 Windy Way contains units similar to our proposal. Condo unit 6.2 consists of an apartment
located on the first and second floors. Condo unit 6.1 contains retail and office space. Condo unit
6.3 contains residential space on the second floor. Other fast floor residential properties in the
CN zoning district are located at 46 and 46A Surfside Road. Although not located within the CN
zoning district, there are two condominiums directly abutting the subject property with first floor
residential units located on Boynton Lane. 16A & 16B Boynton Lane contain residential space
on all floors. Attached to this residential space is unit 16C, which contains garage /warehouse and
office space similar to our subject property. 8A & 8B Boynton Lane units also contain residential
space on all floors including the first floor.
The property setbacks have changed with the zoning district change. The rear property setback
has been increased from 5' to 10'. The existing structure as built in 1981 and modified in 1987
and 1997 does not conform to the new setback regulation. This is a pre- existing non - conforming
condition created by the zoning change.
