DECISION:
1. Upon review of the application submitted by the
Applicant for the above - referenced property, it was
determined by the Zoning Administrator that pursuant
to Nantucket Zoning Bylaw Section 139- 33.A.(3)(a), the
proposed addition to the structure will not increase
the nonconforming nature of said structure.
2. The Applicant is proposing to alter the existing
structure (dwelling) by constructing an addition to
the deck on the east (rear) side of the structure.
The proposed deck addition will conform to the rear
yard setback requirement and will be no closer to the
side yard than the existing deck.
3. The Locus and the structure are preexisting
nonconforming to the SR -20 district. The Locus was
previously located in the R -1 district. The structure
was completed pursuant to the R -1 standards and a
Certificate of Occupancy was issued in 1982. The
structure is preexisting nonconforming with respect to
front yard setback, with the structure being located
about 16.9 feet from the front yard lot line, in a
zoning district that requires a 20 foot front yard
setback, and to side yard setback with the structure
being located about 6.6 feet from the side yard lot
line in a district that requires 10 feet. The ground
cover ratio is 30% in a district that allows a maximum
of 12.5 %.
4. Therefore, because the proposed deck addition is
conforming to the rear yard setback requirements and
will be no closer to the side yard setback than the
existing deck, as shown on the site plan entitled,
"Proposed Deck Addition" dated August 20, 2013,
attached hereto as "Exhibit A ", the proposed addition
will not increase the nonconforming nature of the
structure on the Locus.
