Upon review of the application submitted by the Applicant for the above - referenced property, it was determined by the Zoning Administrator that pursuant to Nantucket Zoning Bylaw Section 139- 33.A.(3)(a), the proposed addition to the structure does not increase the nonconforming nature of said structure. 2. The Applicant is proposing to alter the existing structure (dwelling) by constructing an addition to the deck on the south side of the structure. The proposed deck addition will conform to all setback requirements. 3. The structure on the Locus is preexisting nonconforming with respect to front yard setback, with the front stoop /steps being located about 9 feet from the front yard lot line, in a zoning district that requires a 20 foot front yard setback. 4. Therefore, because the proposed deck addition is conforming to the setback requirements as shown on the site plan entitled, "Proposed Deck Addition" dated September 25, 2013, attached hereto as "Exhibit A ", the proposed work will not increase the nonconforming nature of the structure on the Locus. Minor changes to the shape, design, or configuration of the deck shall not require a modification to this approval.
