An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a notice of
appeal, specifying the grounds thereof, with the Town Clerk, pursuant
to Nantucket Zoning Bylaw section 139- 29.C.(6)

DECISION:
1. Upon review of the application submitted by the
Applicant for the above - referenced property, it was
determined by the Zoning Administrator that pursuant
to Nantucket Zoning Bylaw Section 139- 33.A.(3)(a), the
proposed addition to the structure does not increase
the nonconforming nature of said structure.
2. The Applicant is proposing to alter the existing
structure (dwelling) by constructing an addition to
the rear of the structure. The proposed addition will
be conform to all setback requirements. Additionally,
various maintenance, repair, and replacement work to
various areas of the nonconforming portions of the
structure.
3. The structure on the Locus is preexisting
nonconforming with respect to front yard setback,
being sited as close as 9.7 feet from the front yard
lot line, with the front stoop /steps being located
about 3 feet from the front yard lot line, in a zoning
district that requires a 20 foot front yard setback.
4. Therefore, because the proposed renovations and
alterations to the rear of the structure are
conforming to the setback requirements as shown on the
site plan .entitled, "Plan of Land in Nantucket,
Nantucket County, Mass.," dated September 27, 2012,
prepared by Frank O. Holdgate, attached hereto as
"Exhibit A ", the proposed work will not increase the
nonconforming nature of the structure on the Locus.
5. The Zoning Administrator notes that the plan
referenced in this decision does not show any off -
street parking on or driveway access to the site. A
previous plan submitted with this application
indicated a parking and driveway configuration that
did not meet the requirements of the Zoning Bylaw and
that utilized the public right -of -way for turning
around. The applicant will need to consider how
driveway access and off-street parking will be
accommodated.
