taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a notice of
appeal, specifying the grounds thereof, with the Town Clerk, pursuant
to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the application submitted by the
Applicant, it was determined by the Zoning
Administrator that pursuant to Nantucket Zoning Bylaw
Section 139- 33.A.(3)(a), the proposed alterations to
the structure will not increase the nonconforming
nature of said structure.
The Applicants are proposing to alter the preexisting
nonconforming structure (dwelling). The Applicants
propose to alter the dwelling by raising the existing
structure in order to construct a new foundation and
add a basement. A 36 square foot addition will be
constructed in the front and a 140 square foot
addition will be constructed in the rear of the
structure, neither of which is in the setback. The
Applicant will eliminate the current northern setback
intrusion by demolishing a 24 square foot "wart" on
the existing structure. The structure on the new
foundation will be located no closer to the front yard
lot line than it is currently located (4.1 feet).
The structure (dwelling) on the Locus is preexisting
nonconforming with respect to front yard and side yard
setback, being located as close as 4.1 feet from the
front yard lot line where a 10 foot front yard setback
is required and as close as 2.9 feet from the side
yard setback where a 5 foot side yard setback is
required. The nonconformities pre -exist the 1972
adoption of the Nantucket Zoning By -law. The locus
and structures thereon are conforming in all other
respects.

Based the existing and proposed location of the
subject structure and the proposed addition sketched
on the plan entitled, "Proposed Site Plan" dated July
1, 2013, attached hereto as "Exhibit A" the Zoning
Administrator finds that the proposed alterations will
not increase the nonconforming nature of the structure
and will in fact remove the northern setback
nonconformity. The Zoning Administrator also finds
that relocation of the structure to an area where the
remaining setback intrusions would be eliminated is
not possible due to the shape of the structure and the
Locus.
