Enclosed is the Decision of the Zoning Administrator which has this day
been filed with the office of the Nantucket Town Clerk.
An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a notice of
appeal, specifying the grounds thereof, with the Town Clerk, pursuant
to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION
1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3)(a), the proposed addition
to the structure does not increase the nonconforming
nature of said structure.
2. The Applicant is proposing to alter the existing
structure by constructing a 20' by 20' addition to the
structure. The proposed addition will be outside all
setbacks and will be no closer to the lot lines than
the existing structure. The Applicant is also
constructing 2 new dormers within the existing roof
line of the third floor. Additionally, various
maintenance, repair, and replacement work to trim,
roof, sidewall, and windows within various areas of
the nonconforming portions of the structure will
occur.
3. The structure on the Locus is preexisting
nonconforming with respect to front and side yard
setbacks, being sited over the front yard lot line in
a zoning district that requires a zero (0) foot front
yard setback and being sited approximately 0.7 feet
from the southerly side yard setback in a zoning
district that requires a five (5) foot side yard
setback.
4. Therefore, because the proposed renovations and
alterations will be no closer to the lot lines than
the existing structure as shown on the site plan
entitled, "Plot Plan to Accompany ZBA Application for
#32 Cliff Road in Nantucket, Massachusetts," dated
August 12, 2013, prepared by Earle 5 Sullivan, Inc.,
attached hereto as "Exhibit A ", the proposed work will
not increase the nonconforming nature of the structure
on the Locus.
