The Locus is shown as Lot 1 on Plan No. 2013 -4 and contains a lot area of approximately 4,516 +/- square feet. Said property was the subject of an Approval Not Required ( °ANW) subdivision plan endorsed by the Planning Board on May 17, 2012 and recorded at the Nantucket Registry of Deeds on January 29, 2013. Although the newly subdivided lot is undersized for the Residential Old Historic (ROH), the Planning Board endorsed the subdivision per M.G.L. cAl §81P based on the exception clause of M.G.L. c.41 §81 L. Per section 139- 33.A.(8) of the Nantucket Zoning Bylaw, these newly created lots are given the status of preexisting, nonconforming lots of record. In addition to being preexisting nonconforming with respect to lot size, the structures on the Locus are preexisting nonconforming with respect to setbacks. The structure is sited as close as 4.9 +/- feet from the westerly side yard lot line; 3.2 +/- feet from the easterly side yard lot line; and 1.2 +/- feet from the southerly rear yard lot line all in a zoning district that requires a five (5) foot side and rear yard setback. The structure conforms to ground cover, having approximately 1,354 square feet of ground cover and a ground cover ratio of 29.98% in a zoning district that allows for a maximum ground cover ratio of 30% for undersized lots, but up to 50% ground cover ratio by Special Permit pursuant to Section 139- 33.E.(2)(a). The Applicant is proposing to alter the existing structure by constructing the following additions: new steps in the westerly side yard setback; a new ground floor additional totaling approximately 318 square feet of ground cover; a new covered porch addition that will not count towards ground cover; new steps in the easterly setback, and new steps and landing towards the rear of the structure. The Applicant also proposes to convert the preexisting nonconforming garage to an outbuilding. As a result of the proposed additions, the new ground cover will be 1,672 square feet and will have a ground cover ratio of approximately 37.02 %. Per section 139 - 33.E.(2)(a), for lots less than 5,000 square feet, the maximum ground cover ratio shall be 30 %, but can be increased to up to 50% by Special Permit relief from the Board of Appeals. Accordingly, the Applicant is requesting this Special Permit relief to increase the ground cover ratio to 37.02 %. The Applicant is also requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(4) and (5) in order to alter and extend the preexisting nonconforming structure without increasing the nonconforming distance to the lot lines. Although said alterations will be within the easterly and westerly side yard setbacks, they will be no closer to the easterly and westerly lot lines than the existing structures. Further, because these alterations will be no closer to the lot lines than the existing structures, the work proposed will not be substantially more detrimental to the neighborhood than the existing nonconformities. The Nantucket Zoning Board of Appeals held a public hearing on September 12, 2013, in the Community Meeting Room at the Public Safety Facility at 2 Fairgrounds Road, Nantucket, Massachusetts, regarding the application of Karen Castles Gray, 280 Park Avenue, Manhasset, NY 11030, Board of Appeals File No. 050 -13. The Board made the following Decision: 2. The applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(4) and (5) and 139- 33.E.(2)(a) in order to alter and extend the preexisting nonconforming structure on the Locus and increase the ground cover above the 30 %, the ground cover which is allowed by right for undersized lots in the Residential Old Historic (ROH) zoning district. The Locus is situated at 7 Green Lane, is shown on Nantucket Tax Assessor's Map 42.3.3 as a portion of Parcel 86, is sbown as Lot 1 on Plan No. 2013 -4, and evidence of owner's title is recorded in Book 1378, Page 277 at the Nantucket Registry of Deeds. The property is zoned Residential Old Historic. 3. Our Decision is based upon the application and accompanying materials and representations and testimony received at the public hearing. There was no Planning Board recommendation on the basis that no matters of planning concern were presented. There was no testimony in favor of, or in opposition to, the application at the hearing. 4. Attorney Ricbard J. Glidden represented the applicant. Attorney Glidden explained to the Board that the applicant of 7 Green Lane, shown as Lot 1 on Plan No. 20134, is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(4) and (5) and 139- 33.E.(2)(a) in order to alter and extend the preexisting nonconforming structure on the Locus. Specifically, the applicant is proposing to alter the existing structure by constructing the following additions: new steps in the westerly side yard setback; a new ground floor additional totaling approximately 318 square feet of ground cover; a new covered porch addition that will not count towards ground cover; new steps in the easterly setback, and new steps and landing towards the rear of the structure. The applicant also proposes to convert the preexisting nonconforming garage to an outbuilding. The Locus is shown as Lot 1 on Plan No. 2013 -4 and contains a lot area of approximately 4,516 +/- square feet. Said property was the subject of an Approval Not Required ( "ANR") subdivision plan endorsed by the Planning Board on May 17, 2012 and recorded at the Nantucket Registry of Deeds on January 29, 2013. Although the newly subdivided lot is undersized for the Residential Old Historic (ROH), the Planning Board endorsed the subdivision per M.G.L. c.41 §81P based on the exception clause of M.G.L. cAl §81L. Per section 139- 33.A.(8) of the Nantucket Zoning Bylaw, these newly created lots are given the status of preexisting, nonconforming lots of record. In addition to being preexisting nonconforming with respect to lot size, the structures on the Locus are preexisting nonconforming with respect to setbacks. The structure is sited as close as 4.9 +/- feet from the westerly side yard lot line; 3.2 +/- feet from the easterly side yard lot line; and 1.2 +/- feet from the southerly rear yard lot line all in a zoning district that requires a five (5) foot side and rear yard setback. The structure conforms to ground cover, having approximately 1,354 square feet of ground cover and a ground cover ratio of 29.98% in a zoning district that allows for a maximum ground cover ratio of 30% for undersized lots, but up to 50% ground cover ratio by Special Pemrit pursuant to Section 139- 33.E.(2)(a). As a result of the proposed additions, the new ground cover will be 1,672 square feet and will have a ground cover ratio of approximately 37.02 %. Per section 139 - 33.E.(2)(a), for lots less than 5,000 square feet, the maximum ground cover ratio shall be 30 %, but can be increased to up to 50% by Special Permit relief from the Board of Appeals. Accordingly, the applicant is requesting this Special Permit relief to increase the ground cover ratio to 37.02 %. The applicant is also requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(4) and (5) in order to alter and extend the preexisting nonconforming structure to construct the additions proposed. The proposed additions will not increase the nonconforming distance to the lot lines. Although said alterations will be within the easterly and westerly side yard setbacks, they will be no closer to the easterly and westerly lot lines than the existing structures. Further, because these alterations will be no closer to the lot lines than the existing structures, the work proposed will not be substantially more detrimental to the neighborhood than the existing nonconformities as shown on the plan entitled, "ZBA Permit Plot Plan," prepared by Nantucket Surveyors, dated October 2, 2013, attached hereto as "Exhibit A." 5. Therefore, because the proposed additions will be no closer to easterly and westerly lot lines than the existing structures and because the additional ground cover totaling 318 square feet results in a ground cover ratio of 37.02 %, which is less than the 50% ground cover ratio allowed for conforming lots in the ROH, the proposed additions will not be substantially more detrimental to the neighborhood than the existing nonconformities and will be in harmony with the purpose and intent of the Zoning Bylaw. 6. Accordingly, by a UNANIMOUS vote of the sitting Board, the Board GRANTS Special Permit relief pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(4)(5) and 139- 33.E(2)(a) allowing the proposed additions as shown on the site plan entitled, "ZBA Permit Plot Plan," prepared by Nantucket Surveyors, dated October 2, 2013, attached hereto as "Exhibit A" and the conversion of the existing garage to an outbuilding with the following conditions: a. There shall be no exterior construction in connection with this project between Memorial Day and Labor Day of any year; and, b. The outbuilding shall not have a bathroom.
