ADDENDUM "A"
The Applicants, F. Helmut Weymar and Caroline S. Weymar; are the owners of a single
family dwelling located at 79 Baxter Road, Siasconset, Massachusetts 02564 shown as Lot 13 on
Land Court Plan No. 9710 -F filed with Certificate of Title No. 10,627 at the Nantucket Registry
District for the Land Court ( "Premises "). The Premises is also shown as Parcel 32 on Nantucket
Assessor's Map 49. The Premises is a pre - existing, non-conforming lot of record located in the
SR -20 Zoning District. The Premises has an area of approximately 15,555+ square feet, 103.44
feet of frontage on Baxter Road, a front yard setback of 43.6 feet at its closest point, side and rear
set back distances greater than ten (10') feet, and ground cover of 1,930± square feet (12 0/9). The
zoning intensity regulations for the SR -20 Zoning District are: minimum lot size, 20,000 sq. ft.;
minimum frontage, 100 feet; minimum front yard setback distance, 30 feet; minimum side and
rear setback distance, ten feet; and maximum allowable ground cover ratio, 12.5% of lot area.
The fierce northeastern storms of last winter and spring caused significant erosion to the
Sconset Bluff along the eastern side of the Premises and threatening the location of the existing
dwelling. The Applicants request a Special Permit pursuant to Section 139- 33A(4) of the By-
Law to relocate the existing dwelling within the thirty (30) foot front yard setback area along
Baxter Road as shown on the Proposed Conditions Plan. In the alternative, the Applicants
request a Variance pursuant to Section 139 -32 of the By -Law to relocate the existing dwelling
within the thirty (30') foot front yard setback area. The shape and topography of the Premises are
unique and different from other lots in the SR -20 Zoning District. The eroding coastal bluff on
the eastern side of the Premises threatens the integrity of the existing dwelling and failure to
grant the requested Variance relief will cause the Applicants a significant personal and financial
hardship. Moreover, the requested zoning relief, if granted, and the relocation of the existing
dwelling within the thirty (30') foot front yard setback area will not be substantially more
detrimental to the Baxter Road neighborhood than the location of the existing dwelling. For these
reasons, the Applicants ask the Board of Appeals to grant them a Special Permit or, in the
alternative, a Variance, to relocate their dwelling within the existing thirty (30') foot front yard
setback area along Baxter Road.

1. At a public hearing of the Nantucket Board of Zoning Appeals held on Thursday,
September 12, 2013, at 12:00 p.m. at 2 Fairgrounds Road, Nantucket, Massachusetts 02554, on
the Application of F. HELMUT WEYMAR and CAROLINE S. WEYMAR with an address of
79 Baxter Road, Siasconset, Massachusetts 02564, the BOARD made the following DECISION:
2. The Applicants are requesting a Special Permit pursuant to Section 139- 33A(4) of
the By -Law, or in the alternative, a Variance pursuant to Section 139 -32 of the By -Law, to allow
the relocation of their existing house on a pre- existing, non- confomdng lot. The lot has an area
of approximately 15,555± square feet. The minimum lot size requirement in the SR -20 Zoning
District is 20,000 square feet. In all other respects, the existing house complies with SR -20
zoning intensity regulations. The Locus is situated at 79 Baxter Road, Assessor's Map 49, Parcel
32, Land Court Plan No. 9710 -F, Lot 13, and evidenced by Owner's Certificate of Title No.
10,627 at the Nantucket Registry District for the Land Court. The Locus is zoned SR -20.
3. Our decision is based upon the application and accompanying materials,
representations and testimony at our public hearing. Attorney Kevin Dale presented the
application and stated that the eroding Sconset Bluff on the eastern side of the Premises
threatened the location of the existing dwelling. Attorney Dale said the Applicants intended to
relocate their house 7'6" from thew western property line along Baxter Road, at its closest point,
and construct a retaining wall along the western and northern side of the Premises, as shown on
the attached site plan. Attorney Dale stated that the shape and topography of the Weymar lot was
unique and different from other lots in the SR -20 Zoning District and the imminent threat of
erosion will cause the Weymars significant hardship if the dwelling is not relocated as requested.
Attorney Dale said there is no feasible alternative to relocate the existing dwelling on the lot
except with a reduced front yard setback and the Nantucket Historic District Commission has
approved the relocation of the dwelling.
4. Accordingly, by UNANIMOUS VOTE of the sitting BOARD, the BOARD OF
APPEALS grants a VARIANCE for the relief sought by the Applicants pursuant to Section 139-
32 of the By -Law in accordance with the Site Plan of Land to Accompany a Zoning Board of
Appeals Application in Nantucket, MA prepared for F. Helmut Weymar and Caroline S.
Weymar dated September 11, 2013and prepared by Blackwell and Associates, Inc., P.L.S., a
copy of which is annexed hereto as Exhibit "A ".
