Upon review of the application submitted by the Applicant, it was determined by the Zoning Administrator that pursuant to Nantucket Zoning Bylaw Section 139-33.A. (3) (a) , the proposed alterations to the structure will not increase the nonconforming nature of said structure. 2 . The Applicant is proposing to alter the preexisting nonconforming structure (dwelling) in two phases. Phase I will include raising the existing structure in order to construct a new foundation. The structure on the new foundation will be located no closer to the front yard lot line than it is currently located (8 . 8 feet) . Phase II will include the construction of a rear addition of not to exceed 300 square feet. The rear addition will meet all setback requirements. 3 . The structure (dwelling) on the Locus is preexisting nonconforming with respect to front yard setback, being located as close as 8 . 8 feet from the front yard lot line where a 20 foot front yard setback is required. Two other accessory structures located on the lot are nonconforming to side yard setbacks, however, no changes to those structures are proposed. The Zoning Administrator notes that the buildable area of this lot is restricted due to the location of wetlands on the lot and the extremely close proximity of the 50 foot wetland buffer zone to the existing structure. The Zoning Board of Appeals previously granted zoning relief by variance for more intense redevelopment of the site in 2009 and 2010, however, the former property owner did not activate those permits. 2 of 3 4 . Based the existing and proposed location of the subject structure and the proposed addition sketched on the plan entitled, "Exhibit A-1 Existing Conditions Site Plan of Land to Accompany Board of Appeals Application" dated April 8, 2010, attached hereto as "Exhibit A" the Zoning Administrator finds that the proposed alterations will not increase the nonconforming nature of the structure on the Locus . As requested, the project may be completed in Phases . However, building permits for each phase shall be issued within two years of the date of this decision.
