DECISION:
1 . Upon review of the application submitted by the
Applicant, it was determined by the Zoning
Administrator that pursuant to Nantucket Zoning Bylaw
Section 139-33 .A. (3) (a) , the proposed alterations to
the structure do not increase the nonconforming nature
of said structure.
2 . The Applicant is proposing to alter the preexisting
nonconforming structure (dwelling) by adding a second
story to a portion of the structure. The maximum
ridge height of the proposed addition will be 28 feet,
which is less than the maximum allowed height pursuant
to Zoning Bylaw section 139-17 and less than the
existing height of the structure. The proposed second
story will be located entirely within the existing
footprint, will not increase the ground cover ratio,
and will not increase the side yard setback
nonconformity on the south side of the structure.
3 . The structure (dwelling) on the Locus is preexisting
nonconforming with respect to height, with the ridge
height of the structure being 30 . 8 feet where a
maximum of 30 feet is allowed, pursuant to Zoning
Bylaw section 139-17, and with respect to side yard
setback where a portion of the structure is located as
close as 7 . 1 feet to the southerly lot line in a
district that requires 10 feet for the front and side
yard setback for lots abutting 2 or more streets or
ways.
4 . Based on the plan entitled, "ZBA Permit Plot Plan #24
Walsh Street in Nantucket, Massachusetts" prepared by
Nantucket Surveyors, LLC. , dated July 29, 2013 and
revised on August 2, 2013, attached hereto as "Exhibit
A" the Zoning Administrator finds that the proposed

alterations will not increase the nonconforming nature
of the structure on the Locus .
5. The Zoning Administrator notes that an existing deck
on the north side of the structure is partially
located within the required five (5) foot side yard
setback. The applicant is proposing to remove the
deck and construct a covered porch in approximately
the same location, however, it will located entirely
outside of the required side yard setback as noted on
the plan. No relief was proposed for the side yard
setback encroachment.
