DECISION:
1 . Upon review of the application submitted by the
Applicant, it was determined by the Zoning
Administrator that pursuant to Nantucket Zoning Bylaw
Section 139-33.A. (3) (a) , the proposed alterations to
the structure, namely the addition of a rear deck,
does not increase the nonconforming nature of said
structure.
2 . The Applicant is proposing to alter the preexisting
nonconforming structure (dwelling) by adding a deck to
the rear of the structure. The proposed deck will be
approximately 370 square feet and will located no
closer to the northerly side yard lot line than the
existing structure.
3 . The structure (dwelling) on the Locus is preexisting
nonconforming with respect to side yard setback, where
a 10 foot side yard setback is required on one side
and 5 feet is required for any additional side yards .
The structure was constructed in accordance with the
side yard setback requirements of the Residential
Commercial 2 (RC-2) zoning district in which the
property was located until it was rezoned to
Residential 5 (R-5) at the 2009 Annual Town Meeting.
The north side of the structure is approximately 5. 4
feet from the side lot line and the south side of the
structure is as close as 5 . 1 feet from the lot line.
4 . Based on the plan entitled untitled plan prepared by
Bernheimer Architecture dated May 8, 2013, revised on
June 11, 2013 and attached hereto as "Exhibit A", the
Zoning Administrator finds that the proposed
alterations will not increase the nonconforming nature
of the structure on the Locus .
