1. Upon review of the application submitted by the
Applicant, it was determined by the Zoning
Administrator that pursuant to Nantucket Zoning Bylaw
Section 139- 33.A.(3)(a), the proposed alterations to
the structure do not increase the nonconforming nature
of said structure.
2. The Applicant is proposing to alter the preexisting
nonconforming structure (dwelling) by constructing an
addition of the basement and first floor levels of the
structure. Applicant also proposes to add an attached
storage shed to the northeast side of the proposed
addition and deck to the rear of the proposed
addition. All proposed alterations will be no closer
to the required side yard setback than the existing
structure. The ground cover ratio will be expanded
from 5.3% to 9.6 %, which is less than the maximum
allowance of 10% in the VR district.
3. The structure (dwelling) on the Locus is preexisting
nonconforming with respect to the side yard setback
with the structure being sited as close as 5 feet in a
district that requires 10 feet.
4. Based on the plan entitled, "Plan to Accompany Zoning
Board of Appeals Application at #45 Starbuck Road in
Nantucket, MA" prepared by Bracken Engineering, Inc.
dated July 1, 2013, attached hereto as "Exhibit A" the
Zoning Administrator finds that the proposed
alterations will not increase the nonconforming nature
of the structure on the Locus. Alterations to the
dwelling will not result in an increase to any setback
nonconformities and will located further away from the
northern (side yard) lot line than the existing
structure.
