1. Upon review of the application submitted by the
Applicant, it was determined by the Zoning
Administrator that pursuant to Nantucket Zoning Bylaw
Section 139- 33.A.(3)(a), the proposed alterations to
the structure do not increase the nonconforming nature
of said structure.
2. The Applicant is proposing to alter the preexisting
nonconforming structure (dwelling) by placing a new
foundation and first floor framing under a portion of
the structure (about 135 square feet), adding a second
story over a portion of the existing first floor
(about 114 square feet), and other interior
renovations that are not subject to this decision. All
proposed renovations will occur within portions of the
structure that meet the required setbacks.
3. The structure (dwelling) on the Locus is preexisting
nonconforming with respect to the side yard setback
with the structure being sited as close as 4.4 feet in
a district that requires 5 feet and with respect to
ground cover ratio with 33% existing in a district
that allows a maximum of 30% for pre- existing
nonconforming lots with less than 5,000 square feet of
lot area.
4. Based on the plan entitled, "As -Built Plot Plan #11
Milk Street in Nantucket, Massachusetts 02554"
prepared by Nantucket Surveyors, Inc., dated December
20, 2012, attached hereto as "Exhibit A" the Zoning
Administrator finds that the proposed alterations will
not increase the nonconforming nature of the structure
on the Locus. Alterations to the dwelling will not
result in an increase to any setback or ground cover
nonconformities, and will result in no changes in the
footprint.
