DECISION:
1. Upon review of the application submitted by the Owner
and Applicant, it was determined by the Zoning
Administrator that pursuant to Nantucket Zoning Bylaw
( "Bylaw ") Section 139- 33.A.(3)(a), the proposed
alterations to the structures do not increase the
nonconforming nature of said structures.
2. The Applicant is proposing to alter the preexisting
nonconforming structure (garage) on Lot 1 shown on
Plan 2012 -07 recorded at the Nantucket Registry of
Deeds ( "Locus ") by removing the 392 square foot west
bay of the structure and repairing and re- shingling
the remaining westerly wall after the removal. As a
result, a 188 square foot portion of the garage will
remain on Lot 1.
3. Lots 1 and 2 on Plan 2012 -07 recorded at the Nantucket
Registry of Deeds are the product of a division
pursuant to Massachusetts General Law c. 41§ 81L.
Therefore, pursuant to Section 139 -33(8) of the By-
Law, the lots and all structures thereon are deemed
pre- existing non - conforming.
4. The structure (garage) on the Locus is preexisting
nonconforming with respect to the easterly side -yard
setback, being sited zero feet from the easterly lot
line, and rear yard setback, being sited about 1 foot
from the northerly lot line.
5. Based on the easement plan prepared by Emack Surveying
LLC dated May 24, 2013, attached hereto as "Exhibit A"
and the plan 2012 -07 recorded at the Nantucket
Registry of Deeds, attached hereto as "Exhibit B" the
Zoning Administrator finds that the proposed work will
not increase the nonconforming nature of the structure
on the Locus. Alterations to the garage will not
result in an increase to any setback nonconformities,

but in fact will reduce the amount of the mass in the
rear setback on the Locus, thereby partially curing
the rear setback non - conformity. The applicant will
then repair and re- shingle the remaining westerly wall
on the garage after the removal of the west bay. No
other changes to the garage are requested.
