The applicants propose to alter and relocate the existing main
dwelling upon the Premises, which pre- exists the adoption of the
Nantucket Zoning By -law and is nonconforming as to height, having
elevation above mean grade of approximately 31.4 feet, with the
maximum height above mean grade under By -law §139 -17 being 30 feet.
After the proposed work, the elevation above mean grade will be
about 30.9 feet. Accordingly, the applicants request relief by
Special Permit under By -law §139 -33.A for the alteration and
relocation of the pre- existing, nonconforming structure which will
alter the location of an existing nonconformity but not create any
new nonconformity. In the alternative, the applicants request a
finding by the Zoning Administrator that the proposed changes to a
pre- existing, nonconforming structure will not increase any
existing nonconformity nor create a new nonconformity, under By -law
§139- A.(3)(a).

1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, August 8, 2013, at 12:00 noon, at 4
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of Alexander M. Davis and
Michael Janover, as Trustees of Fayaway Realty Trust, c/o Reads,
Gullicksen, Hanley, Gifford & Cohen, LLP, Post Office Box 2669,
Nantucket, Massachusetts 02584, File No. 041 -13:
2. The applicants propose to alter and relocate the
existing main dwelling upon locus, which as represented in the
application pre- exists the adoption of the Nantucket Zoning By-
law and is nonconforming as to height, having elevation above
mean grade of about 31.4 feet. Maximum elevation above mean
grade is 30 feet under By -law §139 -17. After the proposed work,
the elevation above mean grade will be about 30.9 feet. The
applicants request relief under By -law 9139 -33.A, for the
alteration and relocation of the pre- existing, nonconforming
structure, which will alter the location of the pre- existing
nonconformity but will not create any new nonconformity nor
increase any existing nonconformity. Locus is situated at 11
Lincoln Avenue, Assessor's Parcel 20 -136, is shown upon plan
recorded with the Nantucket Registry of Deeds as Plan No. 2006-
88, and is situated in a Residential -1 zoning district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were raised. Except for the presentation by the applicants'
representatives, there was no support nor opposition presented
at the public hearing, in person or by correspondence.
4. As presented by counsel to the applicants, accompanied
by their architect and surveyor, the principal dwelling upon
locus has existed since well before the 1972 adoption of the
Nantucket Zoning By -law. The applicants propose to make
alterations to the structure, and have proceeded before the
ON
Nantucket Historic District Commission and the Nantucket
Conservation Commission. As a result of changes made through
this process, the existing dwelling will be moved somewhat.
Because of the steep bank lying to the east of the existing
house, and the method of calculation of building elevation under
the Zoning By -law, although the dwelling will not be any higher
above its base, its elevation above mean grade will change,
actually being reduced by about six inches. A plan showing the
proposed conditions upon locus, by Blackwell & Associates, Inc.,
dated July 12, 2013, is attached hereto.
5. Based upon this explanation, the Board of Appeals, by
UNANIMOUS vote, made the finding that the proposed changes to
the pre- existing structure upon locus will not be substantially
more detrimental to the neighborhood than the pre- existing
nonconformity, and GRANTED the requested relief by SPECIAL
PERMIT under By -law §139 -33.A to allow he alteration and
relocation of the structure as proposed d as shown upon the
