Any action appealing the Decision must be brought by filing a notice of
appeal, specifying the grounds thereof, with the Town Clerk, pursuant
to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the application submitted by the
Applicant, it was determined by the Zoning
Administrator that pursuant to Nantucket Zoning Bylaw
Section 139- 33.A.(3)(a), the proposed alterations to
the structures do not increase the nonconforming
nature of said structures.
The Applicant is proposing to alter the preexisting
nonconforming structure (dwelling) by placing a new
foundation with a full basement under the existing
structure, without any changes in the footprint,
massing, or elevation above grade. The Applicant is
also proposing to alter the preexisting nonconforming
structure (cottage) by removing a portion of the
structure and restoring its use to a "studio" and
"personal storage ", both of which are permitted
ancillary uses in the ROH district.
The structure (dwelling) on the Locus is preexisting
nonconforming with respect to the easterly side -yard
setback, being sited about 2.6 feet from the easterly
lot line, and rear yard setback, being sited about 3.1
feet from the northerly lot line. The structure
(cottage) is preexisting nonconforming with respect to
the rear yard setback, being sited about 1.0 foot from
the northerly lot line.
Based on the plan entitled, "Additions & Alterations
to: The Dowsett - Halley Residence, 3 Farmer Street,
Nantucket, MA 02554" prepared by Design Associates
Inc., dated April 17, 2013 and revised through June
12, 2013, attached hereto as "Exhibit A" and the plan
entitled "Existing Conditions Site Plan to Accompany
Zoning Board of Appeals Application in Nantucket,
Mass" prepared by Blackwell & Associates, Inc., dated
May 13, 2013, attached hereto as "Exhibit B" the
Zoning Administrator finds that the proposed work will
not increase the nonconforming nature of the structure
on the Locus. Alterations to the dwelling structure
will not result in an increase to any setback
nonconformities, and will result in no changes in the
footprint, massing, or elevation above grade.
Alterations to the "cottage" structure will result in
decreased ground cover and a change of use to
permitted ancillary uses in the ROH district. The
ground cover ratio upon the lot will be reduced from
50.3% to less than 50 %.
