The locus, a portion of the former 10 Prospect Street, Nantucket, Massachusetts is in the
Residential Old Historic zoning district. It has a garage and attached 1.5 story structure that was
an accessory building to the dwelling on the larger lot that is was cut off from in an ANR (to be
heard by Planning Board on May 13, 2013 and completed prior to the ZBA hearing on this matter
- see plan attached). The structure is as close as 0.2 feet from the western side yard lot line and as
close as 1.1 feet to the northern rear yard lot line, where a 5 foot setback is required for each.
These nonconformities pre -exist the 1972 adoption of the Nantucket Zoning Bylaw. The locus is
a lot of approximately 4,527 SF where the minimum lot size is 5,000 SF, has 20 feet of frontage
where the minimum frontage required is 50 feet, and has a regularity factor of 0.42 where a
regularity factor of 0.55 or more is now required. These nonconformities are deemed preexisting
nonconforming by the Nantucket Zoning Bylaw, Section 139- 33(a)(8) on the basis that the locus
is anew lot created pursuant to MGL c. 41, § 81P based on the exception in §81L. The locus and
structures thereon are conforming in all other respects.
The Applicant seeks to convert the use of the structure from accessory to residential.
This change would make the use more conforming under the zoning requirement that accessory
structures require a primary residential structure on the same lot.
Applicant seeks a Special permit under Section 139- 33(a)(4) to convert the structure to a
residence on the basis that a pre- existing nonconforming use will be eliminated, and such change,
extension or alteration is not be substantially more detrimental to the neighborhood than the
existing nonconforming use. In fact, it is more conforming and beneficial under zoning.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, June 13, 2013, at
1:00 P.M., 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the
application of 10 Prospect Development LLC, c/o Reade, Gullicksen, Hanley and Gifford, LLP, 6 Youngs
Way, Post Office Box 2669, Nantucket, Massachusetts 02554, File No. 028 -13.
2. The Locus is a portion of the recently divided 10 Prospect Street, Nantucket, Massachusetts. It is a
portion of Parcel 7 on Nantucket Tax Assessor's Map 55.4.4, and is shown as Lot 2A on Plan 2013 -20 at the
Nantucket County Registry of Deeds. The property is zoned Residential Old Historic. Applicant's title is
shown in a deed recorded at Book 1383, Page 281 at said Registry.

4. Applicant sought a Special permit under Section 139- 33(a)(4) to change the use and convert the
structure to a residence.
5. Our decision is based upon the application and accompanying materials, representations, and
testimony received at our public hearing. There was no Planning Board recommendation on the basis that no
matters of planning concern were presented. There were no letters or abutter comments concerning the
application.
6. Attorney Steven Cohen represented the Applicant at the hearing. Attorney Cohen explained to
the Board that such change, extension or alteration would not be substantially more detrimental to the
neighborhood than the existing nonconforming use and that granting the Special Permit relief would eliminate
the pre- existing nonconforming use. Attorney Cohen asserted that the change would make the use more
conforming under the zoning requirement that accessory structures require a primary residential structure on the
same lot. Attorney Cohen also confirmed that to the extent the locus has grandfathered rights for commercial
use as a carpenters and framers shop, those pre - existing nonconforming uses would be terminated by the
adoption of the requested relief. No exterior changes to the structure were requested.
7. Therefore, after a discussion with the agent for the Applicant, the Board finds that such a Special
Permit for relief sought by the Applicant pursuant to Nantucket Zoning Bylaw Sections 139- 33(a)(4) to change
the use and convert the structure to a residence, as proposed, would not be substantially more detrimental to the
neighborhood because it would eliminate the use nonconformities and would be in harmony with the general
purpose and intent of the Zoning Bylaw.
8. Accordingly, by a UNANIMOUS vote of the sitting Board, the Board of Appeals grants a
Special Permit for the relief sought by the Applicant pursuant to Nantucket Zoning Bylaw Sections 139 -
33(a)(4) to change the use and convert the structure to a residency, with noe�nditions.
