The Planning Board of the Town of Nantucket held a public hearing at its May 24, 2004 meeting regarding a
request for a MulttFamdy$petial Permit for property at 101idnyAcres Lane. The site is located in the
Residential Commercial 2 (RC-2) zoning district as well as the Public Wellhead Recharge District.
Proposal
The site is currendyvacant and two (2) new duplex structures are proposed to be constructed. A total of four
(4) dwelling units will be located on the site with two (2) bedrooms per dwelling unit. The total member of
dwelling units included in this proposal are the maximum allowed pursuant to Zoning Bylaw section 139-8.
Zoning Bylaw section 139 -18 requires a total of six (6) parking spaces (.75 spaces per bedroom) for the sire.
Eight (8) parking spaces are indicated in a gravel parking area as shown on the site plan dated Match 08, 2004.
Special Permit Relief Requested
The applicant is seeking relief from the following Bylaw section:
139-8C Exceptions. Notwithstanding the provisiom of §139 -7E(1) and 139 -8A, the
Planing Board mayin its discretion grant a special permit for mW&famdy
dwellings (see §139 -2A) within the Multi - Family Overlay District as defined in
$139 -4C, subject to the following standards and conditions and anyother
conditions the Planning Board in its discretion may impose to ensure wddomtity
with these standards and wish the reviewobjecrives and performance standards of
§139 -23A;
Basis for Findings
The Planning Board evaluated this application in accordance with she Zoning Bylaw (§ 139 -8, $139-18, §139-
19, and §139 -20.1) and by reviewing the submitted site plan on which the proposed structures were indicated.
A Planning Board public hearing was held on May 10, 2004 at which time the Planning Board heard testimony
from the applicants as well as the public. The Planning Board closed 'he public hearing on May 10, 2004,
The Board finds that
a. the applicants site plan is substantially in compliance with the Minor Site Plan ReviewErquircd
Contents, Review Objectives, and Performance Standards, as specified in §139 -23 of the Zoning
Bylaw. This finding is nude after rwiewof the site plan bythe Planning Board and its stiff;
b. the applicant will fulfill the housing provisions of §139 -8(C) by restricting the dwellings to either year,
round occupancy or peak - seasonal employee occupancy;

r. the parking requirements of $13%18 of the Zoning Bylaw have been ner; and
d. the pmpmed avuctures and uses are in harmonywith the general purpose and intent of the Zoning
Bylaw and men the objectives of the Multi- favuly Overlay District.
Decision and Record of Vote
Based on the aforementioned findings, the Planning Board, on May 10, 2004 voted 5.0 to APPROVE the
above-referenced Special Permit, baud on plans dated March 08, 2004, staff recommendations, and the
following conditions:
1. That this approval is conditional upon conformance with the Planning Board endorsed site plan and
further applications, including those for building permits, shall reference the approved she plan;
2. That a covenant shall be filed at the Nantucket Registry of Deeds referencing the subject lot and
limiting the housing to (a) year round occupancy, (b) peals seasonal (May I to October 30 or any pan
thereof) ernpkoyes housing and by prohibiting occupancy or use by my other nonyear round
residers in accordance with the definition of transient residential facilities or otherwise, shall be
recorded at the Nantucet Registryof Deeds aga'uat the lot. Said covenant shall gran[ erdorcemem
powers to the Town of Nantucket
3. That an apron be mmtructed at the driveways intersection with Thirty Acres Lane. This apron shall
be a etiniamat of en fee[ in depth and flared to a width no greater than fifteen fee[, purnan[ to
Zoning Bylaw section 139 -20.1;
4. That all future landscaping a the driveway entrance be limited to low growing plant material; and
5. That no Certificates of Occupancy shall be issued for any dwelling units until the Planning Board staff
has determined that the site improvements have been installed in accordance with the approved plan.

Said common driveway easement shall be located perpendicular to the roadway known as

feet and with a width of approximately ten (10) feet (five (5) feet on either side of the common
property line for the length of the easement area the purpose of providing access to the parking
areas appurtenant to Lots 4 and 5 as shown on the site plan annexed hereto. This easement is not
intended to allow reciprocal puking on Lots 4 and 5 as the puking spaces on said Lots are
exclusive to units on the Lots but only for common access to the respective puking areas of 8

Each Lot owner shall install, maintain and repair the common portion of their driveway,
including the driveway apron, shared surfaces, whether pervious or impervious, and shall share

perform any and all work in a workmanlike manner and to maintain use of said easement in a
hazardless condition and to hold and save the other harmless and defend against and from any
and all costs and claims arising out of each lot owner's respective use of the easement.

We, H. Flint Raney and Charron P. Raney, Trustees of Tigertail Realty Trust
(hereinafter collectively referred to as the "Grantors') u/d/t dated Much 13, 2003
recorded with the Nantucket Registry of Deeds in Book 814, Page 174, being the owners
of the land generally described above and more particularly described as Lot 4 on Plan
48 -G recorded at the Nantucket Registry of Deeds (the "Premises'7, in accordance with
Section 139 -9C of the Town of Nantucket Zoning By -law, do hereby grant with
QUITCLAIM COVENANTS, to THE TOWN OF NANTUCKET, a Massachusetts
municipal corporation with a principal address of 16 Broad Street, Nantucket,
Massachusetts, its successors and permitted assigns, by and through its Planning Board
(hereinafter "Grantee') in perpetuity and exclusively, for the purposes more specifically
set forth below, a RESTRICTION on the premises located in the County of Nantucket,
situated in the Town of Nantucket.
The terms of the Restriction, as authorized by Section 139 -9C of the Town of
Nantucket Zoning By -law, as amended and authorized by law, are as follows:
A. PURPOSE:
The purpose of this Restriction is to assure that the use of any multi- family
dwelling unit as defined in Nantucket Zoning By -law Section 139 -2A, on the Premises
will be limited to either year -round occupancy or peak, seasonal employee housing and is
hereby imposed as a condition for Special Permit relief granted pursuant to Nantucket
Zoning By -law Section 139- 9C(5). For purposes of this Restriction, the "peak season'
shall mean May 1 to October 30, or any part thereof Except as provided above,
occupancy of any multi- family dwelling unit by non-year round residents, as defined by
Section 139 -2A of the Nantucket Zoning By -law, is prohibited. The foregoing restriction
shall remain in effect for such time as the as the dwellings upon the Premises arx used as
multi- family dwelling units pursuant to the Special Permit relief granted, Grantor or, its
successors or assigns shall notify the Nantucket Planning Board of such cessation of
multi- family use and the Planning Board will, after inspection of the Premises, remove
the restriction by recording in the Nantucket Registry of Deeds a release of restriction.
B. GRANTOR'S COVENANT:
Grantor or its successors or assigns covenants that it will manage and maintain the
Premises in accordance with this Restriction.
C. BREACH: ..
In the event that a breach of this Restriction by the Grantors or by a third party
comes to the attention of the Grantee, such breach will be considered a violation of the

Nantucket Zoning By -law and the Grantee shall have the right to enforce the provision
hereof and take any other action authorized by Section 139 -25 of the Nantucket Zoning
By -law.
D. LEGAL REMEDIES OF THE GRANTEE:
The rights hereby granted shall granted shall include the right to enforce this
restriction by appropriate legal proceedings and to obtain injunctive and other equitable
relief, and shall be in addition to, and not in limitation of, any other rights and remedies
available to the Grantee.
E. DURATION:
This restriction shall take effect upon the issuance of a special permit to the
Grantors pursuant to Nantucket Zoning By -law Sectionl39 -9C, which was recorded at
Baok2,Page lS1 .
The burdens of this Restriction shall nm with the Premises in perpetuity and shall
be enforceable against the Grantors and all successors and assigns of the Grantors
holding any interest in the Premises. The Grantee is authorized to record or file any
notices or instruments appropriate to assuring the perpetual enforceability of this
Restriction; and the Grantors on behalf of itself and its successors and assigns appoints
the Grantee his attomey -in -fact to execute, acknowledge and deliver ant such instruments
on its behalf. The Grantors and the Grantee intend that the restrictions arising hereunder
shall take effect upon the date of this Registry of Deeds. The burdens of this Restriction
shall terminate upon the recording of a releases of restriction as set forth in Paragraph A.
F. INVALIDITY OF ANY PROVISION:
If any provision of this Restriction shall be held invalid to any extent by any court
of competentjurisdiction, this restriction shall be construed as though such provision had
not been included in it.
G. GRANTEE'S DISCLAIMER OF LIABILITY:
By its acceptance of this Restriction, Grantee does not undertake any liability or
obligation relating to the uses of the Premises except as provided herein.
H. NON - WAIVER:
Enforcement of the terms of this Restriction shall be at the discretion of Grantee;
and any election by Grantee as to the manner and timing of its right to enforce this
Restriction or otherwise exercise its rights hereunder shall not be deemed or construed to
be a waiver of such rights.

NO ASSENT TO LICENSE OR PERMIT:
Nothing contained in this Restriction shall be construed as an assent by Grantee to
any license or permit that Grantors may need for the use of the Premises.
RULES FOR INTERPRETING THIS INSTRUMENT:
This instrument is to be governed by, and administered and interpreted according
to the laws of the Commonwealth of Massachusetts. This Restriction is intended to be a
restriction in favor of a governmental body, and as such is not subject to the provisions of
Massachusetts General Laws Chapter 184 Sections 26-30. Words of number or gender
may be read as singular or plural, or as masculine, feminine or neuter, as required by the
context. The section headings are included only me included only for convenience of
reference, and shall not be interpreted to modify the terms of this instrument.
The undersigned on oath and under pains and penalties of perjury hereby certifies
the following:
1. That they are the sole Trustees of the Trust;
2. That the Trust, as amended, has never been terminated from the date of its
creation and is still in full force and effect; .
3. That no beneficiary of the Trust is a minor; a corporation selling all or
