1. Upon review of the application submitted by the
Applicant, it was determined by the Zoning
Administrator that pursuant to Nantucket Zoning Bylaw
Section 139- 33.A.(3)(a), the proposed alterations to
the structure do not increase the nonconforming nature
of said structure.
2. The Applicant is proposing to alter the preexisting
nonconforming structure by making alterations to the
rear of the structure, all as shown on a plan entitled
"Residence, 34 Cliff Road, Nantucket, MA 02554" sheet
A -1.0, prepared by Rosenberg Kolb Architects, PC,
dated March 27, 2013.
3. The Locus is nonconforming as to lot size. The
preexisting nonconforming structure is located within
the required northwesterly side yard setback. The
proposed alterations are located entirely outside of
the required setbacks and will not be any closer to
the northwesterly lot line than the existing
structure. No relief is needed for the trash enclosure
or shower enclosure (the type of shower enclosure
proposed is treated as a "fence" for the purposes of
zoning) as both are exempt from the definition of
"structure" and are permitted within the required
setbacks.
4. Therefore, because the proposed alterations will not
result in an increase to the existing northwesterly
side yard setback nonconformity as shown on the plan
entitled "Residence, 34 Cliff Road, Nantucket, MA
02554" sheet A -1.0, prepared by Rosenberg Kolb
Architects, PC, dated March 27, 2013, attached hereto
as "Exhibit A ", the proposed work will not increase
the nonconforming nature of the structure and will not
create any new nonconformities on the Locus.
