1. Upon review of the application submitted by the
Applicant, it was determined by the Zoning
Administrator that pursuant to Nantucket Zoning Bylaw
Section 139- 33.A.(3)(a), the proposed alterations to
the structure do not increase the nonconforming nature
of said structure.
2. The Applicant is proposing to alter the preexisting
nonconforming structure by adding a deck(s) to the
rear of the structure. The structure is compliant
with the front yard setback, rear yard setback, and
southeasterly side yard setback.
3. The structure on the Locus is preexisting
nonconforming with respect to the northwesterly side
yard setback. The structure is as close as 7.9 feet to
the northwesterly side lot line in a district that
requires 10 feet. I note that this property was
rezoned from RC -2 to R -10 through approval of Article
31 at the 2007 Annual Town Meeting, at which point the
structure became pre - existing nonconforming. The
proposed deck(s) is located entirely outside of the
required setbacks and will be further away from the
northwesterly side yard lot line than the existing
structure.
4. Therefore, because the proposed alterations will not
result in increase to the existing northwa_cterly
side yard setback nonconformity as shown on the plan
entitled, "Plot Plan of Land in Nantucket, Nantucket
County, Mass." prepared by Frank 0. Holdgate, dated
May 2, 2013, attached hereto as "Exhibit A ", the
proposed work will not increase the nonconforming
nature of the structure on the Locus.
