Any action appealing the Decision must be brought by filing a notice of
appeal, specifying the grounds thereof, with the Town Clerk, pursuant
to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the application submitted by the
Applicant, it was determined by the Zoning
Administrator that pursuant to Nantucket Zoning Bylaw
Section 139- 33.A.(3)(a), the proposed alterations to
the structure do not increase the nonconforming nature
of said structure.
The Applicant is proposing to alter the preexisting
nonconforming structure by raising the ridge height to
19' -9" above grade. The existing height is
approximately 16' in a district that allows 30'. The
structure is compliant with side and rear yard
setbacks, and will be no closer to the front yard lot
line than the existing structure.
The structure on the Locus is preexisting
nonconforming with respect to the front yard setback,
being sited as close as 5.9 feet from the front yard
lot line in a zoning district that requires a ten (10)
foot front yard setback.
4. Therefore, because the proposed alterations will not
result in an increase to the existing front yard
setback nonconformity as shown on the plan entitled,
"Mortgage Inspection Plan, #5 East Lincoln Avenue in
Nantucket, Massachusetts" prepared by Nantucket
Surveyors, LLC, dated November 26, 2012, attached
hereto as "Exhibit A ", the proposed work will not
increase the nonconforming_ nature of the structure on
the Locus.
