Applicant also seeks to amend the Special Permit to modify condition 3 to allow a use of the Premises that requires more than 36 parking spaces and, to the extent necessary in connection with the change of use, grant a waiver of the requirement to provide an off - street loading facility per Section 139 -18 (Off- street parking requirements) and Section 139 -20 (Off- street loading facilities) of the Nantucket Zoning By -law (the "By- law "). The Premises is located in the Residential Commercial Downtown (RCDT) Zoning District under the By -law and, as noted, is benefited by the Special Permit (recorded in Book 295, Page 13 at the Nantucket Registry of Deeds), a copy of which is attached hereto as Exhibit A. As noted in the Special Permit, the Premises is pre- existing non- conforming as to lot area (4,251 in a district that requires 5,000 s.f.), set -backs and ground cover ratio (nearly 1008), lack of parking and lack of off street loading. As shown on the survey prepared by Harry R. Feldman, Inc., dated December 13, 1999, as revised June 14, 2005, attached hereto as Exhibit B, the Premises consists of a pre- existing non- conforming 2 story 4,521 square foot building. The first floor contains a total floor area of approximately 3,684 square feet and is permitted to be used as 2 retail spaces. The second floor contains a total floor area of 2,385 square feet and is permitted to be used as one retail space or one office space. 2222265.3 Applicant seeks to modify the Special Permit to change the permitted use of the second floor from a retail / office space to a private meeting room for up to 100 people with an accessory kitchen. The proposed change of use for the second floor is shown on the plan prepared by Burnham Engineering Inc., dated April 4, 2013, attached as Exhibit C. Under the By -law, places of assembly are permitted by right in the RCDT Zoning District. Applicant also seeks to amend the Special permit to modify condition 3 to allow a use of the Premises that requires 43 parking spaces and, to the extent necessary, grant a waiver of the requirement to provide an off - street loading facility with respect to this change of use. In issuing the Special Permit, the Board sought to strike a balance between the Applicant's use of the Premises and avoiding additional impacts to parking and traffic in a critical area. While the proposed change of use to a venue hosting private meetings may technically result in an increase of an additional seven (7) parking spaces for the Premises under the By -Law (see Exhibit D), the proposed meeting room will not actually increase the traffic or parking demands at the Premises. Rather, it is likely that the traffic and parking demands will decrease as a result of the proposed change of use. Unlike the existing retail / office space, the proposed meeting room will be used primarily by Applicant's hotel guests for private business purposes. In that regard, it is not unusual for Applicant's hotel guests to arrive on island without a car and due to the close proximity of Applicant's hotels to the Premises, it is fair to assume that the majority of hotel guests using the meeting room will likely walk to the Premises. Accordingly, the use will be consistent with the parking and loading conditions currently allowed under the Special Permit because the change of the second floor use to a place to host private meetings will not create an increase in parking or traffic demands. The Applicant respectfully requests that the Board approve the requested modifications to the Special Permit to ratify the historic, 2 2n2265.3 current and proposed conditions with respect to the use of the Premises use and its physical inability to provide parking and a loading zone. As previously determined by the Board in making its findings and issuing the Special Permit, the Applicant has satisfied all of the necessary criteria for granting the requested relief and the request is meritorious and may be granted without derogating from the health, safety, convenience, morals and general welfare of the inhabitants of neither the Town of Nantucket nor the Purpose of the By -Law. In the - alternative and to the extent necessary, Applicant requests a Special Permit under Section 139 -33 A of the By -Law for the proposed change of use and waiver of a required loading facility.
