2. Applicants are requesting Special Permit relief, to
the extent necessary, for a waiver of the required parking
spaces as determined by the Zoning Board of Appeals pursuant to
Nantucket Zoning Bylaw Section 139 -18E. The applicants are also
seeking Special Permit relief pursuant to Section 139- 33A(4) to
extend a preexisting nonconforming residential use by
constructing a secondary dwelling on the site. Variance relief
pursuant to Section 139 -32 for waivers from the side yard
setback requirements of Section 139 -16A is requested to validate
the location of the existing garage structure which is sited as
close as 2.4 feet in a district that requires five (5) feet. The
garage structure was constructed in 1973 and is legally
nonconforming as to setbacks, but does not have preexisting
nonconforming (i.e. "grandfathered ") status because it was
constructed after zoning was adopted in 1972 and did not meet
the setback requirements at the time. The statutory timeframe
for enforcement has expired.
The Applicants propose to demolish the garage structure and
construct a secondary dwelling within the same footprint of the
existing structure.
The Locus is situated at 5 Surfside Road, is shown on Nantucket
Tax Assessor's Map 55 as Parcel 253, and evidence of owner's
title is recorded at the Nantucket County Registry of Deeds in
Book 874, Page 139. The site is zoned Commercial Neighborhood
CN).
3. This decision is based upon the application and
accompanying materials, representations, and testimony received
at the public hearing. There was no Planning Board
recommendation on the basis that no matters of planning concern
were presented. .There were no letters in favor of, or in
opposition to, the requested relief.
4. Kyle Snell, contractor /agent for the Applicant,
represented the Applicant at the hearing. He presented the
application to the Board and explained that the Applicants have
reconsidered their request and would prefer to move the
structure to a location on the lot that meets the setback
requirements for the CN district.
5. Therefore, after a discussion with the agent for the
Applicant, the Board finds that pursuant to Nantucket Zoning
Bylaw Section 139- 33A(4), a Special Permit to extend the
preexisting nonconforming residential use would not be
substantially more detrimental to the neighborhood than the
existing use and would be in harmony with the general purpose
and intent of the Zoning Bylaw. Based on the modified sketch
plan presented to the Board by the agent for the Applicant, the
Board determined that Variance relief is not required and that
the three (3) parking spaces shown on the plan should be
reconfigured to meet the dimensional and other applicable
requirements of the Zoning Bylaw.
6. Accordingly, by a UNANIMOUS vote of the sitting Board,
the Board of Appeals grants a Special Permit for the relief
sought by the Applicant pursuant to Nantucket Zoning Bylaw
Sections 139- 33A(4) in order extend the preexisting
nonconforming residential use by constructing a secondary
dwelling on the site, subject to the following conditions:
a. That the three (3) parking spaces shown on the plan shall
be reconfigured to meet all applicable Zoning Bylaw
requirements;
b. That the final location of the secondary dwelling shall
meet all applicable Zoning Bylaw requirements.
