Enclosed is the Decision of the Zoning Administrator which has
this day been filed with the office of the Nantucket Town Clerk.
An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3)(a), the proposed
alterations to the structure will not increase the
nonconforming nature of said structure.
The Applicant is proposing to extend the rear deck and
add an outdoor shower. Said deck and shower will be
no closer to the rear yard lot line than the existing
structure.
The Locus is nonconforming as to lot size, having
about 4,717 square feet in a zoning district that
requires a minimum lot size of 5,000 square feet;
nonconforming as to setbacks by having the main house
sited as close as 2.2 from the easterly side yard lot
line and the studio sited as close as four (4) feet
from the rear yard lot line in a zoning district that
requires a five (5) foot side and rear yard setback;
and nonconforming as to height, having a maximum ridge
height of approximately 33.5 feet where 30 feet is the
maximum allowable height.
Therefore, because the proposed alteration will not be
any closer to the rear yard lot line than the existing
structure as shown on attached site plan entitled
"Renovated Site Plan," attached hereto as "Exhibit A ",
the work proposed will not increase the nonconforming
nature of the structure on the Locus.
