An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(6)

1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3)(a), the proposed
renovations to the structure will not increase the
nonconforming nature of said structure.
2. The Applicant is proposing to alter the structure such
that the structure will now meet the setback
requirements of the Commercial Downtown (CDT) zoning
district. The Applicant is also proposing to add
approximately 413 + square feet of ground cover to the
structure. The structure is presently conforming with
respect to ground cover and will remain conforming as
after this addition.
3. The structure on the Locus is nonconforming as to use,
having multiple dwelling units in a single structure;
is nonconforming as to side yard setback, being over
the side yard lot line by approximately 0.4 feet in a
district that requires a zero (0) foot side yard
setback; and is nonconforming as to height, having a
ride elevation of approximately 43.37 feet which is
approximately 34 feet above mean grade, in a zoning
district where the allowable height is thirty (30)
feet above mean grade.
4. The Applicant proposes to renovate and add on to the
structure in accordance with plans approved by the
Historic District Commission in Certificate of
Appropriateness No. 59,016.
5. Therefore, because the plans reduce the number of
dwelling units to two; the proposed alterations will
cure the zoning side yard setback violation; the

proposed alterations and additions will still be under
the maximum allowable ground cover ratio for the CDT
zoning district; there is no alteration to the portion
of the structure which exceeds the height limitation;
and the addition and renovated portion of the
structure will not exceed the height limitation of the
CDT zoning district, the proposed alterations do not
increase the nonconforming nature of said structure or
uses thereon.
