Enclosed is the Decision of the Zoning Administrator which has
this day been filed with the office of the Nantucket Town Clerk.
An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(6)

1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3), the proposed alterations
to the structure do not increase the nonconforming
nature of said structure.
2. The Applicant is proposing to make minor interior
alterations to the structure and to remove the
existing exterior stairwell and replace it with a
second floor balcony. Said stairwell and balcony are
located in the buildable portion of the Locus. There
is no change in ground cover as a result of said
alterations.
3. The structure is nonconforming as to easterly and
westerly side yard setbacks, being sited as close as
two (2) feet from the easterly side yard setback and
zero (0) feet from the westerly side yard setback in a
zoning district that requires a five (5) foot side
yard setback. The structure is also nonconforming as
to ground cover ratio, having a ground cover ratio of
approximately 55% in a zoning district that allows for
a maximum ground cover ratio of 50 %.
4. Therefore, because the proposed alterations will not
be any closer to the lot lines than the existing
structure and will not increase the ground cover ratio
as shown on the plan entitled, "Nantucket MA," as
modified by S.M. Roethke Design, Inc., attached hereto
as "Exhibit A ", the proposed alterations to the
structure will not increase the nonconforming nature
of said structure.
