Enclosed is the Decision of the Zoning Administrator which has
this day been filed with the office of the Nantucket Town Clerk.
An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(8), the proposed alterations
to the Locus do not increase the nonconforming nature
of said Locus.
2. The Applicant is proposing to alter the existing lot
by subdividing it into two (2) separate lots, as shown
on the attached plan as Lots D -1 and D -2. Said plan
has been endorsed by the Nantucket Planning Board as
an Approval Not Required subdivision plan. Lot D -1
will have access to Tristram's Avenue via the Land
Court Way. Lot D -2 will have access over the existing
traveled way. Said subdivision will be nonconforming
as to frontage as neither lot will have frontage as
defined under Bylaw Section 139 -2.
3. The pre- subdivided Locus is nonconforming as to
frontage, having no frontage as defined by Section
139 -2.
4. Therefore, because no frontage has existed on the
Locus as defined by Section 139 -2 and no frontage will
continue to exist as a result of this subdivision, as
shown on the plan entitled, "Plan of Land in
Nantucket, Massachusetts," prepared by Emack
Surveying, LLC, dated December 7, 2012, attached
hereto as "Exhibit A ", the proposed alteration to the
Locus will not increase the nonconforming nature of
said Locus.
