Enclosed is the Decision of the Zoning Administrator which has
this day been filed with the office of the Nantucket Town Clerk.
An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3), the proposed alterations
to the structure do not increase the nonconforming
nature of said structure.
The Applicant is proposing to alter the existing
structure by adding stairs to the side of the
structure adjacent to Tattle Court and by adding a
deck to the rear of the structure. Both additions are
outside all setbacks and will not increase the ground
cover ratio of the structure.
The structure is nonconforming as to side and rear
yard setbacks, being approximately zero (0) feet from
the northerly side yard setback and approximately one
(1) foot from the southerly side yard setback. The
structure is also nonconforming as to ground cover,
having a ground cover ratio of 50.2% in a district
that allows for a maximum ground cover ratio of 308
for undersized lots. The lot is nonconforming as to
lot size, having about 1,755 square feet in a zoning
district that requires a minimum lot size of 5,000
square feet.
Therefore, because the proposed alterations will be no
closer to the southerly lot line than the existing
structure and because there will be no increase in
ground cover ratio as shown on the plan entitled,
"Proposed Conditions Site Plan to Accompany Zoning
Board of Appeals Application," prepared by Blackwell
and Associates, Inc., dated February 11, 2013,
attached hereto as "Exhibit A ", the proposed
alteration to the structure will not increase the
nonconforming nature of said structure.
