DECISION:
1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3), the proposed alterations
to the structure do not increase the nonconforming
nature of said structure.
2. The Applicant is proposing to place a new foundation
beneath the existing structure. The applicant also
proposes to add additions to the structure that will
be outside all setbacks. There will be no change to
the height of the existing structure.
3. The structure is nonconforming as to height, being
above the allowed maximum ridge height of thirty (30)
feet.
4. Therefore, because the proposed alterations will not
increase the height of the structure as shown on the
plan entitled, "Plot Plan to Accompany Submission to
the ZBA," prepared by Emack Surveying, Inc., dated
February 12, 2013, attached hereto as "Exhibit A ", the
proposed alteration to the structure will not increase
the nonconforming nature of said structure.
